Thank you! Do I charge rent for the whole month and what damages can I charge for?
The tenant has been there for 9 years and they gave me notice on the first that they would be out bu the 25th. Now they say the can be out by the 10th and want to know how much to pay for this month. Am I entitled to charge them for the whole month?

Also, since they have been there nine years, there's a lot of stuff not working. Garage door opener (I fixed it 4 times), broken door knobs, broken base board heaters, leaking refrigerator. What do I chalk up to wear and tear and what is damages?

YES! They must pay for rent for the full month. Tenants are required to pay rent thru the end of their 30 days notice weather they actually leave before that or not. The end of the month would be the end of their notice, had they given proper notice.

That is all general wear and tear. Damages are ONLY things they specifically damaged. Like punching a hole in the wall. Obvious things like that.

EDIT: 9 daughters is wrong. Heaters and door nobs DO normally break with general wear and tear, especially since they have been there for 9 years. Any property manager knows that heaters and things break all the time.

YES, you are entitled to charge RENT for entire month since they did not give the legally mandated 30 days advance notice of vacation.

Leaking fridge probably isn't their responsibility. Broken baseboards depend. . . .if it's mechanical breakdown, you are responsible, if they stepped on, kicked, bent, whatever, it's theirs. Damage is when they have done something to cause breakage, such as knocking hole in wall or door, breaking off doorknob (losing screws), breaking windows, removal of items. Missing items you can charge them for, such as missing doorknobs, missing garage door opener.

You have to give written notice to them of items you are charging them for. Wear and tear are things that happen with normal use, such as worn pathways in carpeting or on hardwood floors.

yes you can charge them a whole month because that is the month you will not be able to get tenants in. So you will lose money if they stay longer then after the month end.

If you took a deposit from them do a walk around and check any damages and charge them with carpet cleaning fees.

Yes you can charge them for a full month. You can't rent for the month when they are still there. After nine years a garage door opener probably needs replaced at your own expense. Same with a leaking refrigerator. Broken door knobs, broken baseboard heaters are damages you can charge for. After nine years you will need to paint, but they need to fill in any holes where wall hanging have hung. They need to clean including carpet. If they don't you can charge the going rate for any cleaning. Check the landlord/tenant laws in your state as they are all different. Do a walk through once they have everything out and point out anything you see and give them time to take care of it. You have 30 days to return their deposit and they have to give you a forwarding address to mail it to. Provide them with a list of any charges. I am a landlord

A lot of this depends on locale and laws for renting. But, I would say if it's specified in the lease they are required to give a specified time notice before moving you are entitled to expect that much in rent for the current month. If no written lease I would expect you to prorate.

As for the damages, broken items are up to the landlord to repair. Some of what you describe is normal wear and tear. Nothing they could do would make a refrigerator leak. Door knobs do wear out and baseboard heaters quit working. You would be expected to use their deposit for this stuff if it is suspected that the damage was done intentionally. Otherwise they should get a portion or all of it back. If this damage or failure to function problems were reported to you and you failed to fix them in a timely manner then it's your problem. That's one of the good things about renting versus owning when it comes to mechanical or plumbing failure/breakdown or any other no blame problems. The owner gets to fix it. It's to be expected unless otherwise stated in the lease.

If they've been there for nine years I would suspect they were decent tenants.

Most states require a 30 day notice to vacate this isn't 30 days therefore they are required to pay the whole months rent.

As for damage 9 years is a long time You won't be able to charge for the broken garage door opener since it's already been fixed 4 times and has been an ongoing problem.

Since you would only be able to charge them a depreciated value on the other items your probably not going to get much even if they damaged an item beyond normal wear and tear. They obviously were pretty decent tenants to have been in the place for 9 years.

Tenants have to give 30 days notice so you can charge them rent for 30 days after the day on which they've given notice. It's the day on which they give you notice that counts, not the day on which they say they will move out. If they gave notice on Nov 1 you can charge them for the entire month of Nov. If they gave notice on the 5th you can charge them rent until Dec 5.

You can't charge tenants for normal wear and tear and, with them having been there for 9 years, that would include quite a bit. Door knobs don't normally break due to normal wear and tear, same thing with base board heaters, but who knows. Unless you can see that a specific trauma happened to break these items it's probably your loss.

If they've been there 9 years they're probably decent tenants so I'd cut them some slack and only charge them for something that was obviously damaged due to their fault.

They are are doing you a favor by moving out early. The prudent landlord would reward them for this esp after nine years. Give 'em a discount.

If there's a lot of stuff not working, it was your look-out to repair/maintain the place in a habitable condition. A leaky fridge should have been repaired or replaced as soon as it was reported. Baseboard heaters are routinely dmgd simply by vacuuming. Broken door knobs are interesting. It's probably arguable that they've been broken for some time.

The key issue here is how forthcoming were tenants in reporting damage? If they never bothered to tell you about anything and these repairs come as a surprise, you should keep some of the dmg deposit. But if you never asserted your right as a landlord to come and inspect the premises in nine years, give them their full dmg deposit back and wish them well. You probably gave as good as you got.

A garage door opener that doesn't need repair four times a YEAR would be unusual indeed. Whoever makes these things should be charged with willful intention to pollute the landfill!

I am an Aparment Manager. I always prorate their rent up to the day they move out. They did not give you a proper 30 day notice so in my policies/lease it states they have to give a full 30 day notice to receive a refund of their security deposit but if there are damages upon move out of course it is deducted from that deposit. I don't know if your lease states they are to pay for a whole month's rent even if they give notice and move before the end of the month???? I always have my tenants do a walk through move in inspection sheet. I walk the apartment with them so they are fully aware if there are damages not on that sheet they are responsible for them. However, those damage charges can not be for normal wear and tear. It has to be something they caused due to their neglect. I also write up all work done in every unit on work orders so I have that for back up. If they neglected to tell you about any work needed they are responsible for paying for that damage. The broken door knobs, baseboards are their neglect. The gargage door opener was that damaged by their neglect or misuse and the same for the frig? If you can determine it was then you can charge them for it.
