bean407 | The house i'm renting is in foreclosure if I stop paying rent can I appeal a eviction if he files one.florida? |
I feel as a renter if the owner is not trying to resolve the debt owed he knowingly is breaking the rental agreement between us not allowing my family and self to stay for the duration of lease |

Sorry but the landlord's status with the bank has no bearing on your lease contract with him. You would have no legal defense in court to appeal an eviction and the laws in FL are very landlord friendly. |

Your 'feeling' doesn't translate into law. You are obligated to pay rents due to the current owner as long as said owner legally owns the premises. That translates to the very day the ownership changes hands. The mortgage situation of the current owner has ZERO effect on your obligation to pay. |

Nope. As long as he has posession, you have no valid right to judge what he is or isn't doing to keep posession.
Once he loses posession, it's someone else's issue. |

No just because someone is in foreclosure doesn't give you the right to live in someone else's house for free. |

Yes, by law they can evict you, you have a contract and more likely the owner is trying to use your rent money to negotiate with the bank.
In these days almost everyone who is in a foreclosure process, will be modifying their loans and getting out of the problem. If you feel that you aren't confortable with the situation, talk to your landlord and explain how you feel about it.
Note: people wo appeal evictions are losers and they only want to take advantage of somebody;s disgrace.
Being honest is the best way to act. Talk and come to an agreement.
Don't stop paying because you'll be on the street in no time, think in your family first, no the few dollars you might"save" |

No, you will not win this. You owe him the back rent, need to move and will have a lovely eviction on your credit report to warn others of your greedy nature.
It was not up to you to decide anything in regards to the landlords affairs. If you really thought you had the right to live there for free you should ahve obtained the court order first. |

You will loose on the appeal. You must continue to pay your landlord the rent until you are notified to begin paying it to someone else. You do not live anywhere for free. |

NO! His foreclosure has nothing to do with your rent or your lease. He has NOT legally broken your lease. You are legally required to pay until the day you move out. If you stop paying rent he is with in his legal right to evict you. You have no grounds to appeal.
Not fair- but legal. |

I'm a Florida property manager. Don't stop paying rent and your landlord cannot evict you because he is in foreclosure. Further, the bank has to honor the terms of your lease when they acquire title. Also, he hasn't breached the terms of your lease unless he tries to evict you. If he does, by all means go to the hearing.
