There is a patio space in front of my flat, but is it my space or my upstairs neighbour or both of ours?
I live on the ground floor of a terraced house and my neighbour who lives in the flat above, constantly leaves black bin liners for the refuse men to collect outside the front door. Right next to the our front door there is a wall with some floor space just outside the bay window of my lounge (its quite small) and is seperated from the main road by a small wall. We both rent our flats.

My question is who has the right for this space? Is it me because it borders onto my flat or is it both of us?

I need an answer so that if I am correct then I can tell her not to leave her rubbish bags where she is currently leaving them...

I would imagine it's yours but it would depend upon the leasing / strata agreement that you are renting under. Check with your landlord or real estate agency or read through your lease.

Ask your landlord, but I'm willing to bet that you are to share it. However, if she's putting her trash in front of your window, suggest she put them where you put yours.

simply call your lanlord and ask him, then make something out of it if it is yours, like pot plants and things, this will discourage her.

Do you own the flats or do you both rent from a landlord?

If you both rent, the the landlord will tell you. If you own it then it will be in the deeds which either you or your mortgage lender will have but your solicitor who you used to buy the flat would be able to tell you.

This sounds like it's a sheared space. If you really want to know go to a solicitor or ytour landlord and request a copy of the deeds to the premises and view the plans of the land where the house is built. This will indicate whether it's shared (communal) or yours.

You could always ask the neighbour politely about not leaving rubbish there, you could maybe ask that you get a large bin on the pavement where you both put your rubbish not to cause any confusion or annoynace!

sorry for the simple answer but why don't you just ask her to place her garbage in another place where they will pick it up the same I am sure you can do this without any fighting and it may result in a friendlier environment for both of you later

Most flats are leasehold, meaning you do not own the actual land the flat stands on but someone else does.
You will need to see the deeds on the flat.

usually, if it is pair of flats, the land at the front is for the use of the upstairs and the land at the back for the upstairs. If you are tenants, check with the landlord, if you own the flat it will show in the deeds

It is probably a shared space as she would have no other place to put her rubbish for collection. Why don't you talk to her and both agree on a position and days where you can both put your rubbish bags for collection. Ask yourself this. Is the roof her roof or a shared roof.

i would assume sharred until you ask your landlord. they could tell you more specifically.

Is hter a better place for her to leave her trash, that you can recommend while you ask her not to leave it there?
