There is black mold all over the house I rent, and I signed a 3 year lease, can I get out of it no problem?
The mold is on the celiings, floors, windows in both of our bedrooms and in the bathroom. Our veterinarian said our animals can get respiratory problems and at the hospital I work in the infectious disease control nurse said it's potentially dangerous and could cause asthma. We signed a 3 year lease about 7 months ago, but this is disgusting. The roof leaks into the walls and ceiling which is crumbling. Our landlord said he probably has to replace the roof and the walls. Do I have to wait around for this? Can I just find a new place and move as soon as I need to? It's getting stuffy in here and I don't even have asthma.

Black mold presents a serious habitability issue. This is a health issue. A lease implies a warranty of habitability, and a house full of mold is not habitable. The mold would void the lease. contact the health department and get an inspection, then get a copy of the results. Use this report as evidence when you have to go to court to get your security deposit back and void the lease.

Move out as soon as possible.

As a shortstop, emergency measure, get a couple of gallons of ordinary white vinegar, pour it undiluted into sprayers, and spray down all the walls until they are soaked. Use the vinegar as an air freshener and spray it into the air. I had someone do this in a basement that had a mold problem and before we could even get into rip out the moldy, crumbling walls, the effect was almost instant. There was a noticable improvement in air quality immediately. Vinegar kills 80% of all mold types. If you have tea tree oil, mix this with water and spray this as an air freshener; this works even better than vinegar as it kills virtually all molds. Tea tree oil is hard to mix with water because it is an oil. Use warm water and keep shaking it as you spray. Tea tree oil is available from a number of online sellers and costs about $40 a quart, but it is wonderful.

Contrary to what the answerer below me said, mildew IS a form of mold or fungus. Mold is a plant, and has many different forms. Mildew is a type of mold plant.

Don't say it, write it! Mail a certified letter to the owner/manager stating the conditions of your house. State that you will deduct the cost of living away from the unit until the problem has been resolved. Contact the health department and they will expendite the process. Take pictures of all of the rooms, and have the owner/manager to come over to see for himself.
Do not stay in the house until they have resolved the problem. They should have a professional to come over and spray all of the rooms. They then have to remove the mold, and paint the walls with Kil Z2 paint.
Most people are not aware that there is white mold and black mold. Both can cause serious health problems.

If you expect to break this lease based upon 'black mold', you will need to verify that what you see is actually harmful mold. Chances are strong that it is NOT black mold, but rather is mildew. This is a situation for your local health department. Your claim of 'black mold' won't cut the mustard unless it's verified as such.

Dude!!!!!!! If its toxic mold you need to GET OUT NOW!!!!! Toxic mold grows in a no sunlight environment with a water source. For instance inbetween walls from a leaking pipe. It sounds like from what you mentioned that its going to be 100% toxic!

Please listen to me when i say you and your family are in serious serious danger. You know how some people say "i dont want to alarm you but"? Well i do want to alarm you. Toxic mold can cause serious brain damage and death.

Some symptoms of toxic mold exposure are headaches, respiratory distress (often misdiagnose as asthma), severe fatigue, inibilty to concentrate, slurred speech, flu like sympoms etc etc.

If you have an independant third party mold tester come out and test the mold for toxic species (namely stachybotrys) and it tests positive for toxic mold any lawyer can get out of the lease ofcourse and recover any losses you have incurred.

PLEASE DONT WAIT! GET OUT NOW!!

And why did you sign a lease on this place to begin with? If the mold is as bad as you say, I find it hard to believe there wasn't anything at all there 7 months ago. If the mold is due to flooding or a natural disaster, there are special rules that govern that. In any case, it does sound as though the place is uninhabitable. Send a letter to the landlord and keep a copy, notifying him that you would like to terminate your lease for the above reasons. Take photos of everything, even pay for an inspection report about the leaks and the structural damage. If the landlord tries to take you to court you will have proof of the problems.

my peers are basically correct;

first you must go from speculation about mold vs mildew.

then, you need to ask your physician if your health is in jeopardy.
if it is, you have a "constructive eviction" and can leave immediately.

not, you then have a different approach; remediation.
you must tell the LL to fix the problem; via a letter to him.
YOU must give him 30 days to fix it.

IF HE DOES NOT---
contact 3 licensed re-mediators of whatever it is that
is there. HIRE the least expensive contractor. Make sure
before he leaves your unit, that you are satisfied with his work.
Pay him--do not ask him to bill the LL.

When you pay Feb's rent [?], send in the rent minus
the amount of the contractor's fee you paid and give the
LL a copy of the paid invoice. That is the legal way to
solve this problem in all 50 states.

The residence has to be safe, and meet conditions required by the Health Department. You can call them, and they will come out to inspect the property. They will require the situation to be corrected.
In fact, you may be able to have the landlord provide temporary residence while the repairs are being made

An unsafe, unresolved condition is grounds to terminate a lease.

Be sure to give the landlord WRITTEN NOTICE of the problem, and state that "time is of essence" to remedy the situation.
