so we've been living in our friends house since december cuz he moved to costa rica. we signed a lease for 6 months, so we're out at the end of this month. we already told him we're leaving so has a 30 day notice. he's in town for the next 4 months
last night he tried to get us to sign some bull **** he typed up "Notice of eviction"
he can't evict us if we've done NOTHING wrong, ALWAYS paid the rent on time AND WE TOOK CARE OF HIS DOG ANS TUPID BIRD!!!!
what the hell?!?!
can he LEAGALLY do this??

He is stupid! If you out at the end of the month and you already paid rent, there is really nothing he can do. Heck, if you did not pay rent, there are time frame and legal steps to take to evict, which in California it takes at least 45 days. FYI, if you have a lease with a fixed time period, you did not even have to give him notice that you were moving. Say the lease says six months, that's a contact for 6 MONTHS! |

It will probably take 30 days for a real eviction notice to go through anyway, but he doesn't sound like a real friend to me. Ask him what the deal is. As long as you have proof you always paid rent then they can't even legally evict you unless you violated the contract some other way. You can file a complaint against your landlord, up at your local city hall, as long as you have proof you paid rent and have not violated your contract. Bring the signed contract with you. As far as the eviction process goes, we don't know what state you live in so that's hard to figure out. |

what is his problem than?tell him legally you are not allowed to be evicted, ur lease is protecting u es if u have paid everything. tell him to leave u alone and will be out at the end of the month. |

Evictions take a long LONG time... On the order of months, not weeks. Don't sign it, but I don't think it would matter anyway. You have a lease for six months, so he cannot kick you out just because he "felt like it". Besides, evictions aren't carried through by "contracts", it's done through the courts. As long as you have some kind of proof that rent is paid in full and up to date you have nothing to worry about.
It's good that you're planning on moving out anyway, this guy sounds like a real winner. Just go about your business and ignore him. Don't break the lease by leaving early! And if he tries to kick you out, call the cops.

You have a lease, and you've met the conditions of paying the rent timely, keeping up the property, giving adequate notice to move at the end of the term.
So why is he evicting you? He didn't give you some kind of reason?
Call a lawyer, but don't sign anything if you don't understand it and agree with it. |

Did you pay Junes rent???? Or are you trying to use your security deposit for June? That's the only thing I can think of that would cause him to send you a notice of eviction. |
