This is about living with a individual i dont want to live with and how to legally get thm to go in a month.?

Change the locks and set the personal belongings on the street. Call the local Police department and let them know, even if they do not care.

Once he has established a residency...IE pays rent, bills, receives mail..he, by law, is a legal tenant. Not being on a lease does not change this. If he refuses to leave after you give him proper WRITTEN notice, then you must evict him through the courts. You can't just throw him or his stuff to the curb. Doing so would leave you open to a law suit for illegal eviction.

simply chk your LL/tenant laws and file an unlawful detainer action against the roomy or FED; serve them and get the program on its way, you'll make a further enemy, but if you really want them out, you'll go to any extent to remove the sourpuss.
follow up and the court will blow them out after being served.
you never know, the roomy may take the hint and get lost early...make sure you have all your personals nailed down.


Trouble
Give proper written notice to terminate the roommate's tenancy. If the roommate does not leave per the notice, you are going to have to evict through the courts.

70-24-441. Termination by landlord or tenant. (1) The landlord or the tenant may terminate a week-to-week tenancy by a written notice given to the other at least 7 days before the termination date specified in the notice.
(2) The landlord or the tenant may terminate a month-to-month tenancy by giving to the other at any time during the tenancy at least 30 days' notice in writing prior to the date designated in the notice for the termination of the tenancy.
(3) The tenancy terminates on the date designated and without regard to the expiration of the period for which, by the terms of the tenancy, rents are to be paid. Unless otherwise agreed, rent is uniformly apportionable from day to day.


Do not try any of the suggestions regarding turning off electric, changing locks or removing your roommate's possessions. You could get yourself in deep **** and end up paying the roommate.

70-24-411. Unlawful ouster, exclusion, or diminution of service -- tenant's remedies. If a landlord unlawfully removes or excludes the tenant from the premises or purposefully diminishes services to the tenant by interrupting or causing the interruption of heat, running water, hot water, electricity, gas, or other essential services, the tenant may recover possession or terminate the rental agreement and, in either case, recover an amount not more than 3 months' periodic rent or treble damages, whichever is greater. If the rental agreement is terminated, the landlord shall return all security recoverable pursuant to chapter 25 of this title and all prepaid rent.

Most places if the person lived with you less than a month you can just tell them to leave. Over thirty days you must evicte them threw the courts.

Send him an eviction notice by certified mail with 30 days notice. If he doesn't leave put his stuff out and notify the police. He will be trespassing. Make sure you get your keys back.

Well since he is not on the lease then you don't have any legal obligation to let him stay. Tell him he has to leave when the rent time he has already paid you runs out, and if he doesn't want to go you can force him out with police.

simple ask him to pay up his dues and leave .as there is no contract you have no obligations.
if he does not listen and move out within given time tell him you will call the law as he will be trespassing on your property.

Just tell them you want him/her out in 2 weeks. The person didnt sign a lease so they have no legal grounds to fight on. Even help them by getting them boxes or helping them pack if they need it. Make sure him or her understands if they aren't out on a certain day you will call the cops. that should do the trick

1) Tell them they need to be out by a set date (the farther out, the more time they will have to get ready).
2) Impress the importance that they get out, providing cardboard boxes from the grocery store to get the point across
3) When you are nearing the date, make sure they understand you will call the police to forcibly eject them if necessary
4) Take away their key!

If they aren't on the lease, they have no legal leg to stand on, so no worries
