I've been in my apartment for 3 months now and having a litte trouble with it's space. It's very small and I really regret signing the lease I did because it was the only apartment I could find so close to school starting. But with spring semester coming up I want to try and get out. The landlord usually fixes everything but is very forgetful. I've sent him a check for the 2nd half of last month's rent and he still has yet to cash it. And it usually takes him 2 or 3 or 4 calls to get things fixed that are broken. Any suggestions at all on getting out? Any help at all is extremely appreciated. Thanks! |

If its things like water damage and stuff you can break the lease for health safety. But you may want to talk to him and explain your situation and maybe work it out wit him. He may ask you to find some one to take over. By that you can post on craigslist that you need a bigger place and describe the apt and see if someoen is interested in taking it and taking over the lease, then your name is removed and theirs is added on. a lease is a legally binding contract and there are very few ways to legally break one.
You have no legal grounds to break your lease. You will have to talk to your landlord and read your lease to see what your lease break fees are. You typically lose your deposit and have to pay some other fees.
EDIT: Subleasing as others suggested is not typically allowed. You must check with your landlord first and he must approve of your found tenant. |

I'm going to answer this one with a hint of hope that you might be able to sublet your apt out to someone else and better yet "assign" them your obligation to make payment. A sublease would still make you liable for all payments (the party you are responsible for would pay you, and you in turn would pay the landlord). This would get you out of the apartment and they would be paying you for the entire remaining lease term (hopefully). To "assign" that interest over to someone else would be the best thing to do since the would release you legal obligation you currently have to make payments, and the "new" tenant (assignee) would be the one directly paying your landlord.
Please note, that if you sublet, you are still liable for any damages the new party may incur during the remainder of your lease... so, choose wisely if you do go this route. |

If there is a problem that leaves you without an essential service your landlord is required to fix the problem within a reasonable period of time. Under local laws, a "reasonable" time is usually defined as 48-72 hours. Local laws also determine what services are considered essential, but they usually include heat, hot water, electricity, and water.
If something goes wrong with one of these services and your landlord fails to fix the problem within a "reasonable" time as defined by local laws, then you could have a valid legal reason to break the lease and move out.
Another possible exception is if the apartment becomes unlivable. For example, if an infestation of mold appears due to a leaky roof, you could break your lease.
Without something extreme like this happening, you have no legal reason to walk away from your lease without paying the penalties as described in your lease. However, talk to your landlord and see what options you have. Maybe they will let you move and only charge you your deposit, or perhaps they'll let you move to a larger unit in the same complex for no penalty.

sorry but you really have no valid reason for getting out. space is something you totally should have considered before signing the contract. it's really not fair to your landlord if you want to bail.
your best option is to just talk to him. maybe he will let you out with minimal penalties. maybe if you can find someone to take over your lease, that would be a good option for all parties because you get out but your landlord isn't missing any money from payment. |
