UK landlord question??
Our landlord has "served notice". He wants us evicted.

The letting agent came round to do a three month house inspetion. She said there was no problem with condition of house. Landlord was there and he said he was unhappy with scuff marks on walls and he wanted it sorting (letting agent said this was general wear and tear but could we sort it too keep peace - so we did)

He then came round again to check on scuff marks and complained that there were weeds in path outside. So we sorted that and he came round again and complained there was moss on driveway and served notice of eviction.

Contract says that we are to keep exterior areas in same condition that they were when we took over tenancy - which they are (reasonable order it says on inventory) The moss is maybe 5 mm diameter and can be flicked off with finger - but he says its too late now!?

Its moss for gods sake - can he really evict us?

Our thoughts are that if we had clean moss up he would have found something else to complain about and so on. Hes not selling house as he wants to put house back on rental market at same price.

its an assured shorthold tenancy - our 12 month contract is due to end of Feb

Most of the above are wrong. He is not 'evicting' you - only a court can do that. He is seeking possession and giving you notice to leave. He has every right to do that provided he gives you 2 months notice in writing, and rightly or wrongly under section 21 of the housing act does not even have to give you a reason.

Your landlord must seek possession in the County Court. To do this he must show "grounds for possession". There are a number of mandatory grounds for possession (under which he is likely to succeed) and a number of discretionary grounds for possession (under which he will have to satisfy the court that his reasons for seeking possession are reasonable.

It is unlikely that, given the circumstances outlined, he can use any of the mandatory grounds. It does not seem that possession will be automatic if he cites the state of the driveway as his reason.

You do not say what type of Tenancy Agreement you have or how long you have been a tenant. I assume it is an Assured Shorthold Tenancy. If this is the case you may find this link useful: http://www.shelter.org.uk

He sounds like a right whiner as a landlord, if he doesn't like how his house is being looked after, why is renting it out in the first place. He sounds like my dad - a house proud freak, who even straightens out a magazine.

It seems as if he really likes you (in my best sarcasttic voice). Seriously though it appears as though he has something against you and wants you out of his house.
The excuses he's coming out with are not genuine enough and he hasn't got a right to kick you out just for the hell of it.
Try not to give him any reason for him to kick you out but like you say I'm sure he'll keep dreaming up excuses.
Maybe it's best if you sort out another place to stay and leave this idiot to his own devices and move out yourself before he has the opportunity to kick you out.

yeah, citizen's advice. and in my opinion don't have any more phone calls with him- and if you do write down the content of the conversation and send it to the letting agent. He's trying to evict you illegally but you can have him for it if you keep writing letters and keep making notes.
make sure if you record a telephone conversation with him you inform him of the recording at the start of the conversation.

private landlords are all misserable tossers they always complain about something so they don't have to pay your deposit back.
if your landlord has served you with section 21 notice and you don't want to leave ,my advice would be to fight the eviction .
take photo's and go to your local council or C.A.B for advice.
moss on the driveway is not a very good reason for eviction !
dirty windows on the otherhand is !

go to citizens advice. He has every right to evict you if he has served you notice HOWEVER with him being so unreasonable maybe you have grounds to not pay your rent as it will also say in your tenancy that you have the right to live there peacefully, your letting agent has said its fine so he is being unreasonable and he can also not come to the premises without 24 hours written notice so he has breached his terms of contract!

I don't think they can do that, I'm sure they can only evict you if they want to sell the house or it's not being kept properly. Speak to the CAB about it.

stop paying your rent.... and he can serve you with eviction... but this takes up to three months to get.... so you save money... and he gets what he deserves... screw the tight bastard... and if he tried to take you to court... which he might... and yes you would have to pay the lost rent... but it will cost him so much more in court fees and lawyers.. that in doing so he will loose money!
