Urgent Renting Question?
If I have been renting an apartment for 10 years, and next month (July) I am planning on moving around 10th-15th, my landlord still requires us to pay the entire month's rent when we only want to pay half of it. Is this right?

The landlord is correct, you only pro-rate on the front in if you move in the middle of the month. You owe rent for the entire month of July, it does not matter which day you move out.

If your lease is from July to July, you pay the entire month. It doesn't matter that you move out in the MIDDLE -- the lease is for the whole year. Your NEW place will probably pro-rate your first month, but not the old place.

This past March, I moved out in the middle of the month, and paid the entire month at my old place. My NEW place pro-rated my rent for the partial month because I moved in on the 12th of March.

Yes, technically they have this right.
You can double check your lease and make sure something else wasn't stated, but generally landlords will charge the whole month, and some would charge until your lease is up. Really kind of crappy that you have been there 10 years and your landlord won't give you a break though.

The rent is in your contract as one fixed date to another. He is under absolutely no obligation to pro-rate the rent. No one pro-rates his expenses, they continue.

Yes, if you're lease starts on the beginning of the month you are responsible for the entire month's rent. Also, unless you are on a month-to-month lease, you are technically responsible for the rent up until the end of your lease. For example, if your yearly lease ends in December and you leave in July, and the landlord can't rent the place, he can hold you responsbile for the rent up until December. Good luck.

In most states the thirty day notice to end the lease usually states its a full rental period month notice to end if so then you can be held to the full month, now certain states like CA is a straight notice period meaning the landlord could not hold you to a full month notice requirement

side note: if you had lived in my rental for ten years i would cut you a break since its hard to find a steady tenant for ten years without having to worry about move out, getting the unit in shape for th new tenant etc,

that said if the landlord is taking that approach better document the condition of the unit, because after 10 years the place will show just under normal wear and tear heavy use for ten years, if the landlord tries to deduct for replacement of rug, painting things like that it should be covered under normal wear and tear after ten years of not painting the place , holes in the wall is not normal wear and tear

Your landlord does have the right to collect the entire month's rent. Assuming you paid a security deposit, the landlord may just keep whatever amount is owed for the rent that you did not pay as that is one reason for collecting a security deposit after paying for any damages that might have occurred. One way or another the landlord could get his/her money owed. Depending upon the reason for your move, the landlord could also collect for any time left on your lease if unable to rent it in that time period. This could also depend upon whether or not you gave sufficient notice and if that notice was in writing, which may be required depending upon the terms of your lease. Sometimes this stuff does depend upon what state you live in as well. Check your lease to find out what the terms were. I

technically yes he's right. If you're in the apartment on the first of the month...no matter if you moved out on the 2nd you are responsible for that month's rent. He sounds like an *** though. If you can pay him half of the rent without him suing you I would.

after renting for this long i would say no as long as you give plenty of notice just pay half i doubt he will come after you for the rest it just would not be worth it
