Your question is confusing. It sounds like the landlord lost the rent check, but in fact you never did pay rent.

They can evict you. It does not matter why you are not paying rent, the simple fact is that you are not. The landlord is not responsible to support your family because you lost your check.

Have a new check printed for you and have the issuer fax over a letter stating when your replacement check will arrive.

If this has never happened before I am sure your landlord will wait a few days for his rent, but you need to let him know what happened and what you are doing to rectify the situation.

2nd, what do you mean "we try to come up with rent"? You either have it or not; and if you gave them the check and it was lost - it doesn't mean that the money wouldn't still be in the bank.

Stop payment and give them another check. However, it sounds like the check was never lost and that you are trying to buy time - especially if you were looking for a loan around the 1st of the month.

**EDIT** So, you have a sickly kid and a mother. These are NO reason not to kick you out for not paying rent.
These are YOUR issues, not the landlord's. They have their own problems, including paying their bills (on time).

They certainly can. If you wrote them a check but they lost it, you should still have the funds available in the account to cover another one. It is their fault that they misplaced the check, but it is not their fault if you spent your rent money.

You are not your landlord's favorite charity, even if you are having problems right now. Your landlord has a mortgage, taxes, insurance, and other bills to pay. Talk to your local housing authority about other housing that might be available.

That is an age old story that landlords hear a lot, that the tenant mailed the check, but it was lost. Or that the check that they were going to use to pay him with was stolen. If you have been with the landlord for a long time (years) and you have always paid the rent on time, he may think the lost check thing is true and give you another chance...I would. As far as your sickly child and mother, the landlord doesn't care about that, it is not his family and he has no obligation to you, he has his own problems, he doesn't need to take on yours. Do you think he should house you for free? Yes he can evict you for non-payment. If everyone that said they had a sickly child and mother stopped paying their rent, landlords would go broke and the banks would foreclose on their property. But, that is not your worry, just as it is not his worry if you have problems.

First of all - having sick kids is completely irrelevant to an eviction for non-payment of rent - I know it may not seem right or fair, but it is legal. Landlords do not care if the kids are sick or anything - they just want the rent. PERIOD. They will not take any sympathy pleas. Try doesn't pay the rent.

Second of all - it is not their fault your check got stolen. You still have to pay the rent or get evicted. Again, sad and not fair, but legal.

There are agencies and churches that will help people in emergency situations. Check with your cities welfare office - they should be able to tell you were help is available before you get evicted.

If the check was lost just do a stop payment on the check and write a new one. If they lost the check, maybe they can waive the late fee.

Check with your bank to be sure the check wasn't cashed. If not, put a stop payment order (some banks will charge for this) and write a new one. If you always pay your rent on time and this is the first time you've been late, they may be looking for an excuse to evict you, so you may want to look for something else anyway.

Even if they lost your check Go to your bank and get a copy of both sides of the check.. If they cashed it then give them hell....if they didn't and you have proof that you paid them by CHECK they cannot evict you.

If the check was lost then it has not been chashed also so do you have the check number if so cancel it so no one can cash it then write a new one with late fees to it as you will have to pay it. If it has been cashed then find out who as the bank can see that then if it was not them then you will have to investigate that but you will still have to pay the rent as they will not wait till the investigation is over.

They can do it as they do not care if the rent is lost. Mailing rent can be like that I mail mine out also and a landlord but sometimes you find the good ones which will help you. Do you live in a village if so maybe call the village of your town they sometimes have help services also that can help you too

if your check was lost you have to have a register book with the number of the check put a stop payment or see who cashed it. If the landlord cashed it he has no right to say he did not get it. If it was with a money order you should have an end that has the number of the money order that will tell if it was cashed and signed by who.
