I'm trying to move into a new apt here in NOLA and what the hell, it seems like every place doesn't allow pets or has a nonrefundable pet deposit. That's not a deposit, that's a fee!! Doesn't $250 seem really steep just for a small housecat?! Is this even legal?! |

It is legal.
This is nothing, it is non uncommon to require over 1,000, especially for a cat. |

SURE it's legal. They don't have to allow pets at all. You don't have to agree with it--go elsewhere.
The worst damage I ever had was from one small housecat. She peed on my brand new textured berber carpeting, ruining it, the padding, the wood, the baseboard. She had been doing it for some time and the twit was living there with the stench, which was unbelievable. She wasn't supposed to have a cat at all, due to new carpeting.
And the security deposit and the pet deposit (fully refundable, not fee in my case) didn't come close to covering the damage of one small housecat. Of course without one tenant allowing this to go on and on, the damage wouldn't have been so extensive.
Another case, tenant with dog. Dog didn't pee on carpet (different carpet), good dog, but carpet was permeated with dog smell. Three steam cleanings, and when humid, still smelled like dog.
In justification of fee, frequently pet damage is difficult to find in walk-through. |

It is completed legal. I agree the word deposit is misleading to some.
Here is how I see it:
Non-refundable deposit = fee
Actually $250 seems extremely cheap, some places in Chicago charge around $500 and up. |

Think about it from the point of view if it was YOUR house and you were renting it to someone. Even a small cat could do damage to a house or apt. What if your cat peed on the carpet? The smell is horrid and at the very least your landlord would have to pay to have the carpet cleaned & deodorized and maybe even have to replace it. In light of that $250 is not much at all. Where I live, it's hard to find a place to accept a pet, and they always charge a fee if they do. Hope that helps make sense out of it. |

Yes its legal. Who wants to live with animals anyway? (I've had bad experiences with roommates and pets). Trust me 250 wouldn't cover half the things these animals have done to apartments I've lived in. So yea, they should make it a true deposit and give you your money back if the animal does no damage. But flea eggs can lay dormant in the winter and then after you move they might get a flea infestation so the only way is to charge you for the flea bombing ahead of time. And then if they get fleas and there are new people living there-- those people might want to move and the landlord has to deal with not having tenants for a few weeks until they get new people. So I'm guessing thats the reason behind the deposit. |

You are correct in that it appears to be a fee rather than a deposit. Most states have definitions of deposits.
You really have two choices. One is to research your state laws regarding deposits and fight your prospective landlord about it. The other is to find a place that doesn't have that wording in their agreement.

I’m opposed to fees on pets, but they are totally legal. I can’t recall ever seeing a refundable pet deposit. I think landlords assume a pet will cause damage or require extra clean-up. |

Yes, it's legal. I do wish that the landlord would call it what it is ... a fee, seeing as you will not be getting it refunded.
WTF is that pets cause damage, extra wear and tear and tend to leave their dander and odor behind.
Pets require cleaning above and beyond normal upon move out.
You are lucky. I require a double security deposit, a non-refundable cleaning fee of $150.00 and $25.00 per month pet rent.
