Herbie | We're having issues with or landlord and mold? help please!!? |
OK, here goes. Last year or so, we had a leak in the bathroom from the tub not draining properly, carpet in the kids room got soaked and we ripped out the padding, floated the carpet to dry it. Then landlord replaced padding.and fixed the tub do it would drain into the pipe and not on the floor.
3 weeks ago we had an issue where the tub developed a crack and leaked eventualy into the kids room again. We don't know how long it was leaking for, but again we did the carpet and padding and pulled the tack strips as per landlord telling hubby to do it. There was mold, mushrooms and stink.
This happened on nov. 23, we called her on nov. 24 and she said her fix-it guy was downstate with his dying mother. No big deal, it gave us time to clear out the kids toys and beds and all that.
Well, she just remembered us yesterday, because she is having an inspection on Monday, dec, 15 for a mortgage re-evaluation. She dropped off a lease to sign which we have never done with her before.
Tommorrw or sunday, we'll be having the shower guys come and install a new tub/shower and a new wall and carpet and stuff in the kids room.
The kids are sleeping in the living room on their folded up mattresses, all their furniture is in there too. There is barely enough room to walk and you stub your toes everywhere. The bunk bed is in our room and we have to shift them to get anywhere. it sucks. We're baciclly living in a hallway.
Today, we called over a rental building inspector to advise us about the mold and what we can do about that. He and his wife know the landlord well, his wife is paid to plow out the driveway. (small town). he gave us good advice.
Now, about an hour ago, landlord calls and said she can do a hazardous health eviction for us, or to us. whatever, she'll help us with the moving, but we'll need to find our own place and pay for it and stuff. We've rented from her for 5 years and its come to this.
Any advice, insight or claing advice would be greatly appreciated about now. Sorry it took so long, but I really needed to get this out there so you know whats all going on. Additional Details She's not a slum lord. its a good place, good neighborhood, good school. great all around except for this past month. She does take care us and the building when stuff lke this is brought to her attention. We just happen to be the ones that this sh** happens to.

i found this on the internet and will include the page it is from hope it helps :) If it does not apply to you please contact your city government and find out what their version says about you moving.
1) Substitute housing. The property owner shall provide, at no additional expense to the tenant, adequate and legal housing for the period that the tenant is required to vacate the structure, as evidenced by a written agreement between the tenant and property owner; or
(2) Relocation payment. The property owner shall provide a relocation payment which is equal to three months fair market rent, plus utilities, as established by the must current federal Department of Housing and Urban Development (HUD) schedule of fair market rents in the County for a dwelling unit which size shall be appropriately computed based upon tenant household size and according to HUD standards. A relocation payment shall be a separate requirement and obligation payable to the tenant in addition to the refund of any security deposit pursuant to California Civil Code § 1950.5 or any other remedy to the tenant available by law.
(3) Extended benefit. If the tenant is required to vacate the structure with less than 30 days' written notice, relocation assistance as specified in Subsections (1) and (2) above shall be extended by one additional month.
(c) Right of first refusal. Any tenant evicted or required to vacate any residential structure as a result of the provisions of this chapter shall be given the right of first refusal to reoccupy a residential structure on the site. To the extent that a unit can legally accommodate the displaced tenant, the right of first refusal shall be applicable within 180 days of the date that such structure becomes habitable, or replacement rental or employee housing is developed on the site.
(1) The owner of such structure shall, at the time the tenant vacates, provide written notice advising the tenant of the right of first refusal option. Said notice shall include the property owner's current residential or business address and telephone number.
(2) The tenant shall provide the property owner with his/her current address and telephone number, which the property owner will use for future notification.
(3) Thereafter, when such structure has been rehabilitated, or replacement housing on the same site becomes habitable, the property owner shall give written notice to the tenant advising such tenant that the structure is ready for occupancy. Such notice shall be made by certified mail, return receipt requested, to the address provided by the tenant. Such notice shall be provided in the same language as the original written rental agreement.
(4) If the tenant does not respond to the notice within 14 days of the notice, or the property owner is unable to locate the tenant upon the owner's good faith effort to locate the tenant, the property owner shall be deemed to have complied with this section, and the tenant's right of first refusal shall be forfeited.

You can get a lawyer, but I wouldn't do it unless it's a freebie through Legal Aid or something like that, since I think your chances of getting any satisfaction are about zero.
Since you can't prove any real gross negligence on the part of the landlord, or deliberate neglect, in most legal jurisdictions she is completely within her rights to do a health eviction -- in fact she'd argue she's doing you a favor by getting you out of a potentially unhealthy situation, and letting you stay might subject her to legal liability.
You effectively boxed her in by reporting the mold situation to the building inspector, and this is now the only safe thing she can do.
Once the premises become uninhabitable, thru fire, flood, health hazards, in most places the landlord's responsibility to you ends there.
Even though it's hard on the renter, the law looks upon it as one of those unpredictable events, like a fire or flood, that just happens, through no one's fault.
You can try a lawyer, but I wouldn't risk much of my own money on it. Better to spend your time finding another place. |

WOW! You probably need to get a lawyer right away and plus! you better take pictures and write down every thing and date it. Mold to my understanding does not just go away you have to replace every thing that was contain of mold, mold is like cancer it just keeps growing, and not to speak of the danger and/or damage it could have on your children health. She should have put your family up in a hotel or in another one of her apartments. She did you guy very wrong call Fair Housing and let them know what is happening to your family. If it where me I hire lawyer fast and not move but make her pay for all your family's inconveniences, etc. She is hoping that you will just go away. |

Take the matter up with the local residential tenancy authority in your jurisdiction. Each place has different rules but, basically, landlord must provide reasonable, habitable premises. There may also be rules where you live about mold remediation and circs in which tenant can apply for breach of contract dmgs and so on. This is much easier than it sounds. The res office will know. |

To really fix a mold problem the house is probally not suitable for habitation during the repairs. DO NOT SIGN A NEW LEASE. Move. That is the only sensible thing to do. Also, take a lot of pictures before you leave should you need them for legal purposes. |

*Notice* Verify the legalities of everything I say, because all contracts are different and I don't want to be responsible for anything that may happen*
But, if it were me, I'd get an estimate from a profession about how much it would cost to repair the damage. If the environment is not safe, it is the professionals obligation to report the owner to the city if he fails to make the repairs or arrange to have the repairs made. If the professional didn't report the owner, he'd be liable to lose his license.
I'd also check the contract to make sure you won't be paying anything for the estimate OR the repairs that need to be made. Most places are desperate for work these days so getting a free estimate shouldn't be very difficult. |

If this landlord is this horrible it is beyond me why you continue to live here. but if she is violating your rights and being a "slum lord" you can report her to the city or you can move out and take it up in small claims court. the only thing that will harm your case is the length of time you have been living there in contrast to the times of the events. a small claims court would wonder if it was so unbearable why you would continue to reside there. i say just get the heck out of here save yourselves all the trouble and report her so some other poor family doesn't have to deal with this slum lord. |
