Stepford Wife | We are renting to own a home and Landlord has told us that his homeowners insurance has gone up to $625.00? |
monthly. Our monthly payment with this increase is $2150.00 per month. I am a Stay at home Mom and we can not afford this!! He told us to try to get our own coverage when we moved in 2 months ago ( we tried, but unless you are the homeowner- you cant change the policy) and he will not fax over documentation to Allstate. They quoted us 1200.00 a year!!
What can we do?? We did not sign a lease for $2150! Our lease shows $1500.00 a month. We love our home- it is perfect for us. But we cant pay for this home!!! Please give me some advice.

I would save all of the evidence I have--emails, phone bills showing that you have tried to contact him, and go to your local Legal Aid office to get some housing info, you can also try the Bar association in your state who may also be able to assist because attorneys are supposed to volunteer a certain number of pro bono hours annually. Remember to keep copies of everything and hold out on your rent until he provides proof. Also try calling the insurance company yourself and ask for a quote anonymously and see how much they charge. When you get to court--you most certainly will be going--bring all of your proof, and ask the judge to have him give an explanation---this doesn't sound kosher. He sounds like he knows the limits of the lease and is trying to get money in any way he can. |

there is NO way that your homeowners insurance should be 625 a month!!!!!!! i pay less than $400 for the year!! i think your landlord is jipping you.. what kind of rent to own contract do you guys have?? i bet you guys are paying all this rent, and he will probably never give you the property.. you need to find out what is going on!!!! seeing as how he won't even e-mail or call you back about something so little, imagine whne you pay off the house and want it signed to you.. i anticipate trouble for you!!!! |

Unless you signed a contract to provide insurance. It is his expense, not yours. Even if you are (just) renting, he has to abide by the contract. If you don't have a contract, you have an implied month to month rental contract. Bring this to a head, immediately ( I think you are being scammed). Quit paying rent. Today! Send a registered letter asking for a copy of the increase insurance policy. Don't admit, or acknowledge that you are paying it (because you shouldn't be). Let him evict you, if he won't show the increase, and, let you talk with the insurance company. It will take him three months to get you out, he has to file an eviction in court. If he does, counter sue for the buying contract. You need to be equal contractor's in this proposition. |

If you have a lease then you don't have to worry. The landlord can't change the terms mid-lease.
Furthermore, he is trying to rip you off. NO homeowners' policy for one home costs that much.
He cannot legally evict you for not paying this. If he tries, talk to an attorney (the first consultation should be free, and all it might take to get this landlord off your back is one phone call from that lawyer). |

There is no reason for his insurance to be $625 a month. Ask for proof and renew your attempt to insure the place yourself. I pay a quarter of that amount monthly for an entire apartment building. Even the quote you got for 1200 a year is only like 100 a month. |

I would ask to see the policy. I will guarantee you should not be paying that much per month. If you get the policy number you can contact the agent. I would like to bet that the 625 is a six month policy. Even at six months that seems high. I guess that would depend on where you live. By the way that is less than 105 a month. That sounds reasonable. Good luck

Unless you're on a month to month contract, your lease cannot be arbitrarily changed.
It sounds like, if he's being honest, that the owner may have neglected to pay for the homeowner's coverage, and the mortgage company has taken out their own policy. Which they can do to protect their interest. Which, has been known to be astronomical.
It would have been his responsibility to take out a dwelling policy (a lot cheaper) and expected you to take out a renter's policy.
Realize you're still in a good position. The landlord will not find anyone to make those kinds of payments. Unless, he's lying and trying to get you to move for other reasons.
Although you're trying to keep the lines of communication open, your landlord is bound by your agreement. Since he's provided no proof of increased coverage, you're not obligated beyond the terms of your lease agreement. |

You have rights, and the first one is to be shown proof of the increase. You need to see the increase letter in hand. If you are on a lease, and you may need to check with a lowyer, but I know in Michigan that is not leagal. A LAND CONTRACT, he can add insurance and taxes NOT A LEASE! The lease must be prefigured and the amount on the lease is the amount you are liable to pay.
a LEASE with purchase option means a portion of the rent goes to the deposit as a down payment for when you buy.
You cannot get a homeowners insurance if you are renting, so it sounds like your landlord wants the best of both worlds.

You can't get homeowners insurance unless you own the home, but you can get renters insurance. He owns the home and is responsible for insuring it. You are responsible for insuring your belongings and for getting your own liability insurance.
I am mystified as to why you didn't manage to figure that out on your own.
Unless you somehow agreed in writing to pay his costs, it's pretty simple ... don't. |
