When we moved in I saw the previous owners leave with the loft ladder. Not a great issue, I replaced it with one from a DIY shop. It cost about £30. Now the house I am moving to doesn't have one. The fixtures and fittings list we filled in for their solicitors, didn't detail a loft ladder, so it's not part of the sale.
Can I take it with me? Or am I being incredibly petty? |

even if it is fixed you can take it with you. as long as you have not stated anywhere in the contract documents that you are leaving it, then its yours to do what you want with.
generally, anything that is fixed ie curtains, carpets, cooker etc, is classed as a fixture or fitting. its up to you whether you take or leave them, unless you have stated that you are leaving it in the fix and fittings form and signed it |

With a loft hatch you do expect a ladder to go with it,but as you didn't put it on the fixtures and fittings it is entirely up to you, its a moral dilemma, The house I moved into the previous owners took all the light bulbs and the patio slabs, they obviously had no morals at all... |

By law you can take it as it's not actually listed in your fixture and fittings list . When I moved in to my previous house all the light bulbs had been taken . Now that's what I call petty lol .
Even if the buyer assumed it was part of the house you can still take it as that's why we have fixture and fittings lists so we don't assume things will be left . Of course if they was that bothered they could have asked you to include it on the list.
I would take it with me but leave a good luck card and a bottle of wine that might soften the blow :) |

well, if it wasn't included in the deal then technically it is yours BUT the buyers probably assumed it came with the house, which, in my opinion, it would be common sense.
You can take it but i think it will be petty. It has happened to me where the owner of the house we bought took something that we assumed came with the house and it was gone. We weren't happy with it at all and thought it was quite rude. |

Its your house you can take whatever you like. When you sell your property your solicitor should give you a standard pre-typed list of all the items you wish to leave (or not) as part of the sale price ( things you wich to SELL to the new owners would be negotiated separately). This generally includes things like curtail rails, towel racks, lampshades, etc - you can amend this list anyway you like - it's your property, you're not legally obliged to leave anything (some people have even been know to take the ligthbulbs!) |
