We have a problem with scorpians in our apartment, and want to move out early, can we get out of the lease?
The complex sprayed the apartment, but i wouldn't let them spary the bedroom because of my pregnant wife, and they're basically saying it's not their problem. She was recently stung after the spraying and we need to move now.

Very few scorpions are poisoneous, as you found out.

These are not a valid reason to break a lease, especially since YOU refused to allow the apartment managers to remedy the situation.

This is on you buddy. You can spray for them yourself.

Call the health department and complain. (311) in the US.
This is very serious. Your wife is pregnant and scorpions are poisonious. Get the health department involved or call a local t.v. station to broadcast the situation.

As long as you feel it's a threat, you should be able to break your lease.

You made your error when you refused to allow them to spray in the bedroom. The management attempted to take care of the problem, and you refused to allow them to do so. Now you want to break a lease because you have scorpions you refused to allow to be controlled ?

The complex will be well within its rights to collect charges from you if you don't honor your lease. And, to those who don't think the complex will take you to court, think again. Most DO pursue these issues in small claims court, and they win. Do you want a judgment lodged against you ?

Ryan, this is a two-fold problem. First, think about the logical side of this. Anywhere there are no pesticides, that's where you will find the most creatures,bugs, rats, ect.ect.. So not having them spray your bedroom, just sent out an invite to these critters that they are safe there. I do understand the pregnancy issue, however, if you refuse to let them spray, you make leaving this place your issue. I would let them spray(have your wife stay somewhere else for 48 hours) and if this doesn't solve the problem, you will have an easier time getting out of your lease without needing legal representation. I would find the tenants union in your area and find out what responsibilities lay ahead for you. Good Luck

Where I live, the only way we can get out of our lease is if we pay two months rent after we move. So say we give our notice on January 1st, then we have to pay Jan and Feb rent.

omg, yes you can definitely get out of the lease. just tell them that your leaving and explain why. there ain't **** they can do. they should have taken care of the problem.

Just move...worst case, you lose a deposit. I've broken leases for one reason or another more than once and never lost anything other than a deposit. Generally, it's more trouble for the land lord to take you to court and try to get you to pay the lease off than it is to just hold your deposit, let you go, and move someone else in.

Technically, legally, they can sue you for not finding replacement tenants, and breaking the lease. I would talk to the landlord and say that you'll give a 30 day notice, then ask what they want you to do from there. They may want you to find new tenants. They may charge you for listing fees and/or keep your deposit. They may take you to court. (that is if there is no out clause in your lease) You really should have let them spray the room, your wife could've stayed somewhere else until it was safe to sleep there. Your choice caused more problems, not only for you, but for the well-being of the other tenants. Now, the scorpians have a "safe" place and the landlords will have to spray again. Which in turn, I'm sure will cost them even more money. Not only that, but if you let them spray the whole apartment, and not room, whats the difference? She eats, walks, and lives in the whole apartment, technically with your logic, she really isn't safe anywhere in there.

If they cannot control the problem you should be able to get out of the lease although you may need an attorney.

Not l;etting them spray the bathroom made this your problem, and I don't believe you will be able to get out of the lease.
Did you check w/ your wife's doctor to see if the spray would be a danger to her??
I can understand your concern, but the exterminators deal with this kind of situation all the time.
