We have been here a month, the people next door came over after we moved in and had the kids make us a card that they are a musical family and they make noise! Oh do they ever, kids screeching, drums that sound like they are coming through my bedroom wall, as late as 9 or 10 oclock and 8 in the morning. The people that leased us the house moved in the same neighborhood but away from the noise. I am unhappy as they neglected to tell us there was a childrens/adult active band next door. We have lived here less than a month. Do we have rights to make him give us our deposit back and terminate the lease?. It was not disclosed to us. Thanks Additional Details Also, the band plays in the dining room which is about 10 ft away from our master bedroom! Lots of drums |

There are no laws regarding disclosing the hobbies of the neighbors. It even sounds like the neighbors practice during legal hours.
You have no right to your deposit back and there should be a clause about terminating the lease. Leases do not have to have one, but most do. |

Get a loud speaker and play "Achy-Breaky heart" loudly every time they start playing. Play it for as long as they play every time. In a week or so, they will get the message and tone it down. After all, you can be a country fan and a line-dance family. That song should throw their tempo off when they are playing and its awful ! |

Disclosure laws deal with the property itself. You should have been told of any known problems with the property. Things like "the roof is 10 years old but doesn't leak (or does leak)", "There was a flood in the basement 10 years ago", etc.
Noisy neighbors, while morally right, aren't required by law. You should first talk to the neighbors to ask if they can hold back the playing at 8am and 10pm. If that doesn't work you should learn what the noise laws are for your community and provide them to the neighbors. Last resort would be to call the police to enforce the laws.

They aren't required to tell you about the neighbors. You don't have to fight with the neighbors to get them to quiet down. They politely told you about being noisy, you can politely tell them to quiet down. Try baking some cookies and bringing them over to discuss a solution.
If that doesn't work, I believe because it is an option to buy you can just lease until you move. |

Your complaint should be with the band not the people who leased you the house. Talk to them about the noise and see if you can come to an agreement for when they play. Maybe for just an hour a day and between certain times. Or you could ask that they install sound proofing in their home. They do not have the right to make loud noise all day to the point where you're uncomfortable in your own home. The fact that they "informed" you that they are a musical family seems like they aren't considering their neighbours at all. You need to speak to them first and if they don't comply, call the police. |

Call your local police and ask them about noise nuisance ordinances in your neighborhood. You probably have legal recourse against your noisy neighbors. |

That is a lifestyle...and they have every right to have a band next door if they want to.
No, you do not have the right to get your deposit back or terminate the lease.
All you can do is call the police and they will come out and determine if the noise level violates local noise ordinances.
Other than that, you are stuck. |
