We moved out of our apt and got a $900 bill for carpet replacement!!?
In the bill it said carpet replaced due to pet odors. Well we have 1 freakin cat, not a kennel! And the carpets did not smell at all. And if they did, why would you not get them professionally cleaned for probably $80 instead of replacing them?! It is a 1 bedroom apartment, 763 sq feet w/ the bathroom and kitchen laminate flooring so maybe 600sq feet of carpet.

What do we do? I absolutely will not pay that but it says if not paid it will be sent to a collections agency and I don't want that to mess up my credit.

Well I stopped in and talked to them. They said they pulled up the carpet and the carpet was saturated w/ cat urine. Even thought the cat never once went on the carpet. I asked them to see pics, they didn't take any. I asked them to see the cleaning bill for where they tried to clean it first, they didn't attempt to clean it first. I told them they should've called me when they saw it so I could come check it out. They say thats not their policy. So f them. I emailed a couple lawyers but most of them say the case is too small for them. Not sure which way to go now.

Take them to court maybe you can just get it cleaned,and if not maybe they'll just have to replace it you never know so just take em to court

Shari is right. We are apt managers. If the carpet is older than 5 years we can not charge for replacement ( at least in Wisconsin) this is the point at which it becomes normal wear and tear and should be replaced. But do have to also agree that once pet urine is in the carpet no amount of cleaning will get it out. The pad has to be torn out, the under lying flooring has to be "Killzed" and then sealed. It's a pain

Did you get your security deposit back? If you did and if there was an inspection with you and the landlord present then you can dispute the charges. In any instance I would write a letter to the landlord disputing the charges and request proof of the charges, a cleaning bill because first they have to try and clean the carpet, pictures of the carpet before and after they replaced it. and the acutual bill from both the old and new carpet. If the carpet was old when you moved in then they cant just say it was from you.

Did you pay for professional cleaning when you were vacating the apartment? Did you keep the receipts? And where did he find carpet to be installed for a mere $1.50/sf?

Discuss with your landlord and show him copies of your evidence that the carpet was cleaned and shows only "ordinary wear & tear" since you moved in. He may give up right then and there as he will know he will face a battle to prove anything in court or to the collections agency he aims to use.

If he sends the bill to a collections agency without going to small claims court, you simply dispute the collections with an "I do not owe this." If you are strong enough, you can get rid of them.

If he goes to small claims court, show you had the carpets professionally cleaned and sanitized, and also show photos that the carpets were clean, not stained, and nothing more than the "ordinary wear & tear" since their condition when you moved in.

Many times pet owners cannot smell their own pets. I know from experience from working in someone's house, that if there is the faintest whiff of pet odor, if you get down on your hands and knees and get your face to within a couple of feet of the floor the stench is overpowering. You really cannot get the carpet clean, even with professional service, I have seen this done and it simply did not work. Once the scent of the cleaning agents evaporated, the pet smell was still there.

Having said that, I have a cat and she has always used her litter box and in 12 years or so has never peed on the carpet. It may be you are right, and the landlord is simply making it up to cover the cost of new carpet. It us possible he never even replaced the carpet, and is looking just for more money. If you moved out of the apartment and they deducted it from your security, that is one thing, but if they refunded your security and sent you a bill after the fact that is something else. Ask to examine a section of the old carpet to verify the claim of pet odor. The landlord should have kept some pieces to defend his position. If he did not, then he has no proof. Take him to court; judges will usually side with the tenant in cases where there is no proof of the landlord's claims.

Also, if the carpet was old, it would need replacing due to normal wear and tear, and this is the landlord's responsibility, not yours. So the odds are in your favor, but whatever you do, do not ignore the issue! Address it right away and be willing to defend your position in court.

I was in a similar situation once. It went to court. The judge decided that since the carpet was between 3 and 5 years old, it needed replaced anyway, and that is the landlords responsibility. Hope this helps, if you wind up going to court.
