We own a rental home and the lady who bought the house next door to our rental house wants us to clean an?
overspray from the fence stain that we applied to the fence we built the fence around the yard of our rental house. We had the house built in April 07 and stained the fence as soon as it was put up. There was an existing house next door to the house we had built but it was also brand new and noone lived there. Apparantly my husband got some of the fence stain on the siding of that house. We did not know it at the time. Someone moved into that house in October 07 and just last week we got a call from her stating that we need to clean the siding of her house. My question is are we responsible to do that? She purchased the house 6 months after we stained our fence and shouldn't she have mentioned it to the builder when she bought the house, not 3 months after she moved in? She is calling us daily harrasing us to come clean it. Thanks for your advice!

Tell her to jump in a lake!!! When she purchased the property the stain was already there. She has no right to make demands on you at this point. This is something she should of taken care of with the previous owner prior to her obtaining ownership.

Some people just want everything done for them.

Listen, I bought a house about 6 months ago and the back windows were broken out. I found out that my neighbors kid did it with a BB gun before we bought the house. I didn't take them to court or demand that they pay for new windows. I just went and did it myself.

Write her a letter stating that she bought the house as is and that included the "stain".

I don't think she'd win if she took you to court over this, but if there is overspray, is really is your fault. You might just be neighborly and just go clean it.

You did make the stain. Just be a good neighbor and clean it up.

The right thing to do is to simply clean it up.The simple fact that the owner at the time of the over spray didn't bother with it does not change this.

You could make the argument that she bough the home in its current condition, and to be honest, I don’t know if she could take you to court for something that happened before she was the owner, but as a matter of courtesy, I think you should clean it.

You don’t want her to anger your tenants, causing them to leave and taking away your rental income, and it’s simply the right thing to do since you acknowledge awareness that the overspray is your doing.

Hi stephjerryj,

Is it really worth your time and energy to fight her in the small claims court? You probably have better things to do than worry about petty things.

Like you said, your husband did over spray. Be a good neighbor and be accountable. You are landlords and running a business of renting properties. It is good business practice to keep a good reputation. Your neighbors can be your eyes and ears for your rental property so be nice to them. Why not start your relationship with your neighbors in a good note?
