lavenia o | We rent a house. The landlord is going to repair the plumbing. ? |
We have been told the water will be off to our residence for up to 1 week. Our family consists of 2 adults and 3 children. Also, both adults (myself and my daughter) work at home. Does the landlord have a duty to provide us with somewhere else to stay while this lengthy repair is ongoing? |

Check with your local housing authority. If the plumbing is so bad that the water will have to be cut off for at least a week, the landlord may have to furnish you with an alternate place to live. I would hope so anyway. |

The house is not livable with out water, so I would say yes. Or your months rent should be reduced by one weeks worth. |

No. Unless you can prove the length of the time frame is so long by bad practice of the land lord, such as taking a week to get back with you about, it's your own responsibility to find a place to stay. |

That depends on your lease agreement. More than likely he will make an adjustment to your rent. |

If there are repairs being done to the property that render it inhabitable by the tenant or tenants and these repairs are not the fault of the tenant or tenants, ( termite fumigation, major repairs, etc.) then, it would be the owners responsibility to provide temporary lodging, however, check with your local board of rent stabilization or, Dept. of Real Estate, (www.dre.ca.gov) website first. |
|

bye bye bye
|
It should state that in your lease. If not, you shouldn't have to pay rent for any days you are not living in the home -- If you know you will be out for 7 days, then that months rent should be pro-rated to subtract a weeks' worth of rent.
Also - If you have it, renters insurance might also cover that expense. |

It depends upon where you live.
You'd probably do best by contacting your local City Hall. |

Yes. The landlord has a duty to provide a habitable house. A house without water, by current standards, is uninhabitable. If the house is going to be uninhabitable due to work being done on behalf of the landlord, then he needs to find a place for you to stay or prorate your rent for the month in which the work is going on. (If the work is being done on behalf of someone else - say, the water utility company, or the Home Owners Association - then the landlord would probably not be liable). |

It depends on your lease. Think about it, if you owned the home, would your mortgage company forgive you a week's payments because you couldn't live there due to plumbing repairs? |

I would consult an attorney. |
