No you can't. You don't have the right or authority to do that. You can talk to the landlord an see if he will tear their lease and see if they agree. Also you may take them to housing court and see if you can evict them.. But that will cost you. Or you can move out and sub-lease your part to somebody else. Put an ad on the paper.. Other than that I dunno. Hope this helps

Good Luck

If the sister is not on the lease, you can (and should) give her notice to move. You say the landlord doesn't know about her and the cat. You could be putting yourselves at risk of being evicted because of the cat and/or because you have exceeded the occupancy of the premises. If the place is as dirty as you say, you could be evicted for that -- or you could be charged a cleaning fee when you move out.

If your friend is on the lease and is also part of the problem, you need to let them know that they are responsible for keeping the place clean or they will be subject to eviction by the landlord or will be assessed a cleaning fee when they move out.

Well.. the sister is treading on family relationships... but it may be time to ask her to move on.

Your best friend can be asked to move on as well.. in a nice way. Explain that you and your husband would like to prepare for the baby. But from a legal prospective.. she does not have to until the end of the lease. At which time.. she only has to move if you all move.. if she is your best friend... it should come to that

Keep your husband... lol.. but divvy up the chores.. he should be helping you out now and in the future.

Sadly you cant kick them out for those reasons they have to do something to break the lease...Meaning bringing someone to live in the house illegally giving a key to a random stranger something out of the ordinary...If they were to physically injure you you can legally evict them. I would say your best bet is to find a replacement roommate to take over your name and get yourself signed off and get a new place because unless your roommates are willing to leave you can get them out for those reason until your lease is over.
Best of Luck, Congrats on your pregnancy!!!

If they are on the lease then no you can't kick them out. Get your husband to help you handle this. He should be protecting his pregnant wife from this kind of hassle.

I would recommend looking over your lease and see if you can get out of it. Also look up your renters rights in your state.

no, unfortunately you can't. your tactfulness will be put to the test here. how do you tell people that you care about that they are invading and trashing your space? keep in mind that you now have to think about your family first. so discuss with your hubby what you want for you new future together and go for it and don't back down. all of what is to come may be alot to handle if your pregnant. I've been there before and trust me if they are all equally at fault for the mess, it's gonna offend everyone if you ask them to leave. things may get hairy. while you may not want to hear it, but i have to say the second time that i found myself in this situation i sat down with my roomies and told them the truth that i was leaving cause i couldn't live like that and gave my 30 day notice. they all understood, and were very supportive. of course they also wanted the master bedroom!

A lease is just like any other contract, where only the parties that sign the agreement are bound to it. Your friend's sister does not have the right to be a resident in your apartment and can be asked to leave. I suppose if you really wanted to you could have the lease amended, but this would have to be agreed to by your roommates that had signed the original lease.

After reading your addendum, your first task would be to document the conditions of the apartment. This may come into play if you need to break the lease in the future, if things are not resolved. I would then speak to your friend about having his sister contribute to the costs of living there. She consumes electricity, water, food, etc. that she should cough up some dough for. Then I would talk to your building manager about cleaning up that roach problem, though it may have more to do with the sloppiness of your roommates. If the apartment is cleaned up and the roaches persist, write a formal complaint to the manager. This will be part of the documentation you're gathering. If you are ignored, you probably have an arbitration clause in the lease you can use to have the lease terminated. Every residence carries an implied warranty of habitability that, if you have sufficient evidence, can indicate a breach on the part of the building manager, relieving you of your obligation under the lease and sparing you from losing your deposit under most circumstances.

Hope this helps. Sorry about the confusion earlier.

Believe me when I say I totally understand your situation!

My advice is this:

Start assigning chores. There will be resentment at first but ultimately, you owe it to yourself (and your marriage, and new baby) to get the respect you deserve.

It might not be a bad idea to separate cabinets and grocery shop only for you and your husband.

Are you charging them rent? Can you afford your apartment without their assistance?

That doesn't sound like a very fair situation. No, I don't think you can because their signatures are on that lease so your home is their home as much as it is yours.

You're going to have to sit them down and express your feelings. Especially with a newborn coming, that's an unsanitary living condition you have their, even for being pregnant and the added stress isn't good for you either. But, try contacting your land lord, and see if their is anything that can be done, I doubt it.. But it's worth a shot.

But your best chance is, talking to your husband and then talking with the rest of the group.

you all live together and you had them sign a lease?well it sounds like they are taking advantage of you,and their living style is a lot messier than yours.if your mad,why doesn't your husband say something to them.or is he one of them?if i were you i would say something to your friends/roommates,or tell them to get the heck out.another thing is if they don't have a copy of the lease, burn yours ,that way there is no proof of one.
