It has nothing to do with the agent. You need a legal representative and he is legally bound to ensure that your mortgage is settled before releasing any monies left over. Plus, you will have to sign documents confirming to your buyer that the mortgage will be settled and to fail to do so is fraudulent.

I wouldn't want to buy a house from you.

I assume you would do your own legal work as well as not using an agent. However, the person buying your house would almost certainly have a solicitor acting for them.

When you sell your house it is a term of the contract that any existing mortgages are paid off. The solicitor acting for the other side would be extremely wary of paying the purchase price directly to you because he would be worried about you not paying the mortgage. To protect his client (the buyer) he would either insist you appoint a solicitor, or that he pay the relevant amount direct to the mortgage company.

Even if you somehow managed to get the cash you would then have your mortgage lender, chasing you to enforce the debt.

The mortgage runs with the property. The mortgage does not disappear when you convey the property to someone else. That someone else will be stuck with a house that has a mortgage. So, what will stop you from selling your house in this situation? The simple fact that you will not find anyone stupid enough to buy the house with an existing mortgage lien.

It would be fraud not to settle with your mortgagee.

Certainly illegal and not to be recommended.

You cannot do this even if you wanted to. Your mortgage company/bank has a lien recorded against your property and your solicitor will have to discharge this. You realise that as your deeds have an attachment they are held by your mortgage company who wont release them until the mortgage is discharged. No deeds, no sale.

Theft is theft. Simple. YOU have rights to occupy your home and
you have no legal obligation to go through a title company when
you wish to sell your house.

Any reasonable person will never close escrow without using
a neutral person [ie, escrow company] to do a title check,
and when they do, the lien will show up.

The buyer's contract, if it is done reasonably, will state that
the seller agrees to pay off all mortgages--unless it is
a no money down deal and a seller ccarry back

Since you seem to lack morals, why are you bothering to ask?
