My neighborhood of 78 townhouses has about 32 people that haven't been paying maintenance for over 2 years. They pay the bank for the home but they don't pay for the maintenance costs so their home can't be foreclosed, what can we do? |

The homeowners association can file a lien on each property. Owners cannot sell their homes until the liens are satisfied. The lien can include the missed payment, a reasonable payment penalty not to exceed 5%, interest charges, and legal fees. The HOA can hire an attorney to handle the liens and then bill the owner for the full amount or reasonable attorney fees.
In a deed-restricted subdivision, you can force foreclosure. See your CC&R documents.
If delinquent owners still refuse to pay, you can force foreclosure and evict the owners. In this market, that might not make much sense. However, filing the liens ensures the HOA gets paid. |
