What actions can I take against a apartment complex for unsafe living conditions?
I'm a college student and I live in a basement of an apartment complex with 4 other guys. There is only 1 bathroom, and no air conditioning (there are only fans.) The problem is: The apartment complex has a bunk bed that's 23 inches to the spinning fan. I am 21 inches wide. In addition, my drawer is stacked on top of 2 other drawers because there isn't enough space in the room to put 3 drawers on the ground. If I fall off, I would either hit the drawers or the spinning fan. To be frank, I want to escape this dungeon. Can you guys/gals offer me some legal advice or suggestions to help me escape? Please!!!

I didn't see the place before I moved in because I was in another state. The place isn't cheap either, it's $260+gas+elec. This was the only place available at the time. How the place was described to me over the phone is completely different than the conditions I live in. But since it's done verbally, it's not worth much. I live in Utah. first- It's going to be a bit hard for you because if it was like this when you moved in, this means you agreed to the living conditions.
Second- sounds like there are waay to many people living in a space that sounds like it was meant for one. You agreed to have all these people move in? or were they there when you moved in?
You need to contact legal aid (a free organization) in your area and find out about breaking your lease because of unsafe living conditions. Also contact the housing dept in your school and let them know about this situation. Tell them you can't concentrate in school because of this situation.
Make sure you take photos of everything and document the people you talk to and dates so you can have a record of all that is going on (to cover your ***)

You need to re-arrange your furniture, or MOVE!

Did you see the place before you moved in and signed a lease?

You get what you pay for, my guess is this place is CHEAP!

But it's not dangerous in the rental world....

If the place had air conditioning and it broke, they should fix it. If stairs broke, they should fix it. But if you signed a lease in a place that's too small or just sucks.... that is your fault.

My guess is the place does not impress the ladies either....

from what i ahve read,you knew what you were moving into,legaly there is nothing you can do,if there are safety things,such as,bad wireing,rats,leaky pipes,ect that the owner well not fix,the only way out for is to move,or get one of your roomies to take the top bunck.good luck

Well you could always move to a less cluttered space... The conditions are really unsafe because there are four people living there... If there were less people you would be able to fit easier. Why bunkbeds? Why not two seperate beds? Or just move the bunkbed away from the fan.

The drawers dont HAVE to be stacked... you just have to because there are so many people living there.

The one bathroom and no a/c deal, thats just something you would have to take into consideration before moving in. Thats not his concern.

1st question would be...Are all of you on the lease? If not, you would not have any cause to demand better conditions + you are possibly living there illegally and the super could throw you out.
Bottom Line: I would find a better place to live and be on a lease agreement. The city then governs living conditions.
You are a college student?

You need to look online at your state statutes to see if you even have a leg to stand on. They will outline and define the law and your rights. Look under landlord/tenant laws. You will have more power behind you if you find out what type of conditions the law requires your landlord to maintain. Good luck.

About the only thing you could do is check your state and city ordinances and see if there is something about how many people can live in one place together. In my city, Milwaukee, you're not supposed to have more than 3 unmarried people living together in one place.

You are living in a hell hole. Just MOVE!

If you have a lease, I seriously doubt this slum lord will come after you for breaking your lease.

Just move.

It's cramped if nothing else. Nothing you can sue for or report about. Most people move in knowing what they are getting and if you don't like it, you move.
Air conditioning is a luxury not a right.
Heat is a right. You must have access to it 24/7/365.
1 bathroom isn't a complaint either, sorry.

Just move. They cannot "make" more space so either you or the other guys would have to leave anyway. Cut your losses.

The best thing is to get out, but that is easier to said than do.
I guess the reason you are living with others is you can't afford one on your own.
So the only one who Can complain is the person holding the lease. if no lease and he or she may be on a Monthly tenancy.
If you hold either of these you can complain to tenancy board or the council.Warning if you complain you will most likely be out on the street.
It is a no win problem. only answer is move even if you have to find another group to live with.

go to the papers, university housing office, ask people..
maybe you can get 2 of the people (from the complex or classes) to move into something better with you..
