Don't worry- they do not put people in jail for dept anymore.

You will have to pay the lease break fees and may lose your deposit. All this should be spelled out in your lease.

When you cannot pay those fees, they will take you to court and get a judgment against you. When the judgment goes unpaid, they will send it to a collections agency. At that point you should be able to work out a payment plan.

Doubt you'll go to jail but you could be liable for the unpaid rent for the rest of the lease.

Talk to the landlord and ask them to release you from the lease. They just might do it.

First thing I would do is move. Tell the landlord what happen and get out so that he can rerent the place.

By staying and not paying rent, you are really screwing the landlord. He has bills to pay also, and this is plain and simply stealing. Do the right thing and get out ASAP and leave the place in good condition and clean.

If the landlord goes after you, he will ask for any damages done to the rental. He could also ask for the months rent that the place is empty. HE CAN"T ask for the full balance of the lease if he rents it out. So make it easy for him to rerent the place.

NOPE, you won't go to jail.
TALK to your LL. Explain the situation to him, give him notice. You have a legal obligation to him to pay the rent for more than a year (multi-year leases are a bad idea for this reason), and your lease should set out penalties for you breaking your lease. You are breaking your word, going back on legal obligations, and it is NOT the LL's fault or problem.
Talk to LL, explain situation, and work actively with him to find a new tenant for the house. He will be unhappy because it is difficult to get good tenants in wintertime, and because he thought everything was set up for a year. But LLs are human, also, and many will work with tenants when calamity strikes, particularly if tenants previously had a good record of on-time payments and are longterm. If that's not the case, they may move to evict you and collect the past-due rents, penalties and fees owed in court.

You cannot go to jail - this is a civil matter, not criminal.

The worst thing that can happen is that the landlord will sue you for the full amount due under the lease. He will most likely win a judgment against you, but, he does have to use reasonable efforts to re-rent the house, and your liability for unpaid rent ENDS at the point a new tenant starts paying rent. So, for example, if you move out and stop paying rent with 10 months left on the lease, and after 3 months he re-rents the house to a new tenant, that stops your responsibility for further rent, and he can only obtain a judgment for unpaid rent for those first 3 months, and nothing beyond that.

If your lease allows sub-leasing, you should try to find a new tenant to take your place. Even if it does not, if you find a new tenant and bring him to the landlord, that could reduce the time the house is vacant.

Do you have minor children living in your house; critical ill person; elder parents? If so, this will take longer for you to be evicted.

I would start by being upfront with the owner of the house. Start packing your personal items. Sale what items that you can live without. Have a yard sale to expedite the process of generating cash. If you have two cars, sale one for cash only.

The normal process would be for the owner to give you a thirty day notice if he has a heart. Otherwise, he could give you a three days notice to pay or leave. If you are not moved out by then, he would start the eviction process. Once you have an eviction on your credit report it will stay there forever. The sooner you move out the better off you will be.

If you leave any personal items in the house, whether you are there or not, you will be charged rent for those days. Make sure that you remove ALL items from the house; broken or reusable.

Many people are going through rough times, and some owner are more understanding than others.

You won't go to jail.

If you are behind in your rent they can start eviction proceedings. You'll get a judgment against you to pay back rent and court costs and any other money you owe them. It will be on your credit report for years.

If you break the lease they can sue you for the rent for the remainder of the lease term, although they have a duty to find another renter, and once they do, you won't owe anything else.

You should talk to them, and see if you can find a replacement to take over the lease. That will help a lot. Talk to them first, work something out, don't let them evict you because that will be worse.

You will be liable for the remaining rent, because it was a contract.Which would be brench of contract. you can try to make arrangements to pay with the owner after moving out, also get it in writing. If you miss one payment of which you agree upon the agreement it's then no longer valid.Move out before the 30 day notice is up, you wil get a 3 day notice, then a 30 day notice, respond and when it's time to go to court go and make sure you have that payment agreement to show the judge owner accepted a payment agreement and most likely you are fine. Take pictures of the place once you move out so he won't say you damaged anything, also try to clean everything out, and most of all make copies and keep for your own files. Oh yeah make the payment agreement to what you can afford,nothing more or you will be in the same situation no cash M.O. or personal checks, make a check list. good Luck

You will be evicted, that means the sherrifs department will send like 3 police cars to your home, they will pound on your door and say you have 30 seconds to get out before they lock the door behind you. It's embarrassing.

Go look for another job. Take anything at this point. Have him do the same. Don't just sit back and wallow about the situation that you find yourself in. That is life, its not predictable and it doesn't always lay the cards out on the table like we want :)

You should seriously consider contacting the Board of Social Services or Department of Human Services - they have programs for people who are in emergency situations, if you are about to lose your home, they will give you cash assistance to pay it. Go on welfare. Do whatever it takes. I know my state has a program to help prevent foreclosure where they will help you get out of arrears if you are LOW income. You could also see about like Section 8 or something, some type of help with your monthly mortgage/rent payments. If you provide an eviction notice or something and go up in person, they might give you emergency funding.

Do some searching on your state's website. For example, I live in NJ. State of NJ Website, they you click on the department (they have a drop down list...motor vehicles, human and health services, department of labor, child services, etc.)

The landlord might try to sue you for the past due rent. Don't worry. Whatever happens at this point will happen, you can't stop it now unless you go out and find a job asap.
