What are my options on this situation?
Me and my now ex girlfriend bought a house for 105,000 with an FHA loan. we have had it for almost one year. things between me and her have gone sour and she wants to just get out from under the loan. I know the only way for her to do that is for me to refinance but i dont have any money at all the do that. And if she wants money i dont have that either. What are my other options? I also know i could just foreclose but will my lender be able to try and work something out for me. I can afford the payments but i dont have any extra cash to settle another loan.

and to clear things up a bit....i can pay for the house myself....but she is just worried about being on the loan and what she is entitled to. If she is entitled to anymore than a grand i cant pay her and if i leave the loan the way it is she will still be entitled to any money i make on selling the house latter on

You are both equally liable if you are on title. Best to sell the home or work out a sale/deed change to put it in your name. A title company can do this for you.

It will ruin both your credit if you don't keep up the payments. It is in both your best interest to contribute to the mortgage as agreed until the house is sold. If you are both on title it will take both signatures to sell the home (there are few exceptions), so best to keep it business and get a real estate agent that will work with you both individually and separately to act as the buffer you need.

If you can afford the property on your own, you can continue to make the mortgage payments on your own. Be prepared to retain proof that you ALONE made the payments, for purposes of tax deductibility. Absent refinancing, however, you will not be able to remove your girlfriend from the mortgage obligations.

If there is actual equity in the property and she wants it, you can only refinance to get her what she wants.

she may let you buy her out & if you can be civil, include in your divorce the terms if you can't pay all at once
best bet would be to just cut your losses & sell the house & divide both the profits & the liabilities equally

If you can keep up the payments and not default, try selling. It's your only way out short of coming into a windfall profit. Or...I don't know how much your payment are but maybe you could rent it out for the payment + a little more and move yourself into a cheap apartment that you can afford...OR get a roomy you trust and charge him/her some bucks for living there + part of lights, etc. GET A CONTRACT IF YOU RENT IT OUT OR GET A ROOMY!!!!!!!!

A mortgage of a 25 year term means the in the first year most like only 97 percent of the monthly payments were for interest only. It takes years to get any of the principle paid down. Since this is the year house prices are falling you have not made any equity from a higher selling price. Get her to quit claim out for a few dollars as suggested by the lawyer. You owe her for cooking and cleaning the house.

Of course she's going to want her "fair share" of the equity of the home and profits, if any, from the sale. If neither of you can afford it on your own respectively then you both need to agree on a plan that will protect both the house and both of your credit score/history. She just can't decide to leave and demand the money, especially if her name is all over the loan and title paperwork. I'm sure if you both take some time to think through the whole process you'll both understand the situation and work together to positvely resolve it for both parties.

If she co signed then she is liable for the loan also , but if you did it by your self - sorry find the best way you can
