Ive only been in my new house for around 12 days, and when me and my husband spoke to the previous tenants they assured us the neighbours where really quiet, and as I'm 3 weeks away from having a baby this was perfect! a nice quiet house, thing is the neighbours are so loud, all day and all night, they don't talk to each other they shout, and argue and the swearing is horrific! its really upsetting for me!
Now I have heard that you have rights something about non-disclosure? Does anyone know about this or can tell me what it entails???
Many Thanks Additional Details The estate agents never said it was quiet or loud, I'm afraid we went off what the previous owners said.
And the shouting and swearing goes all night some nights, then it sounds as if they are moving furniture around at 11pm! |

Who's to say they didn't just become loud? You will have to prove they were loud before you bought this house.
Why don't you just get the law involved and see what they can do to calm the situation down if it is unlivable.

You are quite right, your sellers had to complete a disclosure form which your solicitor should have had a copy of. Go back to your solicitor and ask to see the disclosure document. If the sellers didn't disclose the facts you have the right to compensation. However, in reality it would be very difficult to prove that your neighbours were noisy before you moved in. It sounds unjust but that's the way it works. I suggest you ask the police to have a quiet word with them. Good luck with your neighbours and the new baby. |

The sellers should have been honest about noisy neighbours when you asked if it was a quiet area. There has been a few court cases of sellers having to pay compensation to buyers because they lied about noise. Your solicitor will be able to help.
If you can hear the noise, then so should other neighbours. Ask others living by. It should be easy enough to prove that the problem is a long standing one.

yep.. they didn't disclose that fact.. thing is.. most people check the house they are buying covertly at various times of day or night.. that tells you whats REALLY going on.
ask em to pack it in , tell em you've just had a kid and u need some quiet.. failing that just record the baby crying. play them it back at hmm 4-5 am =)
just complain to your local council about noise, my neighbours are doing that a lot.. pity i realise their only doing it to get a ground floor flat. good riddens to em anyway it's a private house i live in and have to live next door in a flat. |

Talk to your friends and get the name of an attorney. Other than suing the previous tenant for withholding information (I'm not sure if that is illegal in this particular case...and you'd have to prove that the swearing was going on while the previous tenant was there), you can always call the cops. Noise pollution is illegal, as is disturbing the peace, and domestic violence.

Call the law on them. Keep doing it. Contrary to belief, persons can be cited with noise disturbance ANYTIME of the day or night. I should know. When I was a teen, we had the stereo blasting in the afternoon, and was ticketed a few times for it. I thought it was crazy at the time, but now that I have kids, I understand. Do get them on tape being loud, at all times of the day. Call the police to come out, and keep records of that. If all else fails, just move. I know that sounds crappy, but you might be happier and won't have to deal with the stress and wars with the neighbors. Who knows you may mot be the first ones to call the cops. Good Luck. |

Talk direct to your neighbors about the noise, see if they can come down, try to be nice to them and if this does not work call police and later on move from the house..... |

I live in an apartment and I *HATE* my upstairs neighbours. I swear to god, last night at 10:13 at night they were using a HAMMER on the walls!!!
Record them yelling. That's disturbing the peace. I'm not sure how it is where you are, but after 10 in the evening M - T, and 11 in the evening Sat - Sun, it's considered disturbing the peace and at that time you have the legal right to call the cops.

go to the c.a.b they have a neighbour friendly scheme to bring both parties together and act as mediator to sort through differences if not make a log and call the local council noise pollution team and they should help with the problem i would strongly suggest the c.a.b first though as the council can be like pouring oil on fire |

first things first. learn and know the number to the police dept. if youneed to call 911, then do so. there are other non-emergency numbers as well. I'm in the same boat. I built a BEAUTIFUL home in a new subdivision. The place was barely developed when my house was built, and now it's become a combination of little Mexico and the hood!! My neighbor has 2 barking dogs that NEVER stop!! The loser thugs that haul *** down the streets in their cars have their stereos up so loud that my walls VIBRATE!! There are now sneakers hanging from various light poles (a sign that drugs are available in the area).
I call the police for the gunshots I hear, and am looking to move ASAP!! I'm going to lose my butt when it comes to selling price but I fear for the safety of my family. Maybe you should talk to an attorney. there WAS a short period when you could back out of the sale, but I'm pretty sure your time's up on that. good luck. you have rights, enforce them!! |
