What are my rights as a Renter?
My Mom and I live in a house her BF owns in SC. Six days ago he told her he has the house sold and we had to be out by last night. That gave us only 5 days to find something, move and relocate. We do not have the extra money for downpayments, etc, etc right now. This is came out of left field. So today we have not moved out. What are our rights. We never had a lease. We were responsible for chores here on the farm in lieu of money for payment. We have held up our end. What can we do to get a extra few weeks to find something?

I believe that you are entitled to a 30 day notice. After that he can begin eviction procedures. Moving is hard and expensive. He is being totally unreasonable.

Wow, your mother is trying to phuck over her boyfriend? Her boyfriend she has been leeching off of? Talk about biting the hand that feeds her.

If you all are shacking up you do not have any rights, other then having the buyer sue all of your a$$es for not leaving.

If your mother really is a renter she can force her boyfriend to evict her, it sounds like she is witchy enough to do something this scummy.

Since she has been living for free she has a nice nest egg saved up, any halfway normal person would.

Legally he can't throw you out, he needs a court order.
However you may be tenants at will. Look up your state LL/Tenant laws.

with out a lease you have little rights. Most give people 30 days to vacate

Unless you signed a lease, it's generally month to month.

They have to give you time though. He can't just kick you out when even he feels like it. He can start the eviction process, but that takes time too.


where is everybody?
your mom and her b/f don't communicate very good. i think maybe he just wants to get rid of you and really didn't sell the house. tell him you need to see the sale papers and see what happens

You definetly do have rights. Even though you do not have a signed lease, you still are living there month to month. I am a landlord. I hope that he has notified you that the house was up for sale. He has to give you 60 days notice. You can go to the landlord and tenent act to read more of your rights. I hope that your mom is no longer with this guy because he just basically threw you out on your behinds without giving you proper notice!

SC law requires the landlord to give a 30 days WRITTEN notice to vacate.

I don't know the legal structure for SC, but if you have a written lease, the terms of notice are in it. In most areas, if you don't have a written lease, you are a tenant at sufferance. The notice has to match the interval between rent payments. i.e. 30 days rent; 30 days notice. if moving is going to be an excessive hardship, talk to a lawyer. It might be worth it.
