What are my rights if I move into a house that is still full of the owners old stuff?
Am I allowed to just get rid of it all - it's not listed on the inventory. We've been here almost a month now and still no news of when the owner will come and get it. When we moved in the estate agent told us that the owner was on holiday and that they would be coming to pick it up 2 days after we moved in. They also left rubbish in the garden and they keep saying that they are geting in touch with the council to get rid of it - but it just doesn't happen - should I get rid of it myself and then charge them the cost?

Are you renting? The landlord is responsible for everything.

You must send the old owner a written 30 day notice by certified mail to pick up their belongings, or else you will donate them. If they fail to respond after 30 days, you are under no obligation to keep their belongings.
Note, save a copy of the letter for yourself, and it is always nice to send more than one just incase they try to sue, you have a paper trail.

First, I would call your estate agent and get them to immediately contact the previous owner, telling them that they have a month to remove their property or you will dispose of it. No, you cannot 'charge' them a cost, without giving them due notice that you will be doing so. Good luck getting the money, if you do.

you can dump the lot if it not on the inventory it not in the house if you get my point and if anyone dose come around tell them the house was cleared by the landlord as it should of been before you move in

and as for the rubbish tell them if it not remove from your garden asap (give them a deadline of a week) you will pay for it your-self and stop the amount from the rent (make sure you keep the bill / invoice as poof of cost)

The Estate Agent must deal with this - this is what they are paid for. Give them a deadline, (say 30 days) tell them after this date you will pay a company to pack and store the goods, and you will deduct the cost from your rent. Don't negotiate, just state your intentions. You are paying rent for the whole space and you are entitled to it, end of story.

After 30 days, and it must be the full 30 days, if the owner has not come to claim their property, you may dispose of it as you like. The property belongs to you, along with anything left behind, afterall, you paid for it. Usually the laws require a 30 day wait, and after that time, ship it off to Good Will, and trash the junk. Recycle plastics, metals, glass, paper, cardboards if possible, but then that's about it.
If you try to bill the former owner of the property for removal of those items, chances are they will not pay you. If you have the owner's phone number or new address, you could call or mail them a nice letter giving them a time limit to come get their things, then you could wait to see if they contact you. But either way, 30 days after you move in, the stuff can be disposed.

Did you buy the house or renting? If you're enting, contact your landlord. If you purchased the home, call the lawyer/realtor who represented you at the closing.

In most cases, homes should be "broom clean" when the new owner takes posession - with some money left in escrow to pay for clean up if it isn't.

Judging by your statement "they were on holiday" I'll assume you are in the UK. My experience has only been in the US market - again, check with your attorney.

get in touch with the estate agent express how concerned u are with the stuff and would like it removed, for u did not sign up to have ur place as somebody elses storage space,!! Getting his/her attention then set a 1/2 week (depening how kind u r) time limit for it to be collected or else, u will throw all out and they(agents) being liaible for the costs, for rent is what u pay to live in not store other peoples sh.. in !!goodluck

It really depends on the state you live in. Most states have a landlord/tenant department in the Housing Department. You could contact them. I believe the state where I live if a tenant leaves stuff in the house I have to notify them in writing my intentions of the stuff they left behind. I give them two weeks and then I can dispose of it. I believe they allow for this because they have abondoned their property. As for the charge back I also believe this would be allowed however; you do need to notify them in writing. Keep the receipt from the dump for the garbage, you could also probably include a fee for the time and gas spent. List it in the letter what you intend to charge for this. Make sure you keep receipts and copies of every letter. You also need to send the letter with a signed return receipt or certified to ensure they get it. Hope this helps.

I suggest you have a word the letting agents before any action is taken. If they say get rid of it get in writing and further get confirmation that you can retain the cost from the next rent due

you can actually charge them a storage fee, for everyday it is there, legally, but after 30 days it becomes abandon property and belongs to you for which you can do with what you want with it, however to make it legal and yourself safe to be sure record it all , how long its been there, write a letter put time and date on it and send this to the owner of the stuff, make sure you make a copy for yourself, tell them they have so many days to come pick up their stuff, or you will be forced to get ride of it yourself, after 30 days of this letter wrote then you may do what you want with their stuff as you legally gave them warning of your plans and a date they should of had it picked up..... Courts will go your way if you have done everything in your power to get them to come get their stuff, if you have documents already saying that they were to pick this stuff up and proof of times and dates then you are already safe to do this process.... its up to you really, I have been and owner/landlord for several years and have had to deal with sort of thing many of times,
depending on where you live I would call a lawyer and or police to find out your laws in your state on abandon property, I am sure its 30 days where ever you are..... and this also backs you up on doing it correctly. more or less saves your butt from getting into trouble. if you have a storage unit around your house place the stuff in that..write the letter of warning, an then after 30 days get ride of the stuff,

its yours after 30 days....

You are obviously renting through an Agency. Ask the Agent to write to the previous tenant giving them 7 days to remove the stuff they still want to keep, and advising after that time it will be destroyed. If ther's no response within that time then obviously you can do what you want with it. With regard to rubbish, it's up to the landlord to foot the bill for the removal as the council will charge you for its removal. Speak with the agent again tell them you want all this stuff removing as you are not paying a substantial rent to live with rubbish/filth and ask them first whether you can employ someone to remove it and what are the arrangements for them reimburising you. Get whatever you can in writing though. Difficult one, but it's only you being inconvenienced and it's you paying the rent! Good luck. (It's something that should have been dealt with by the landlord before you moved in)
