Usha R | What are my rights when buying a house? |
I am buying a house i UK. I have already signed the contracts and made a deposit of 5% of the mortgage through my sollicitor. I was told I will get the keys to the house as soon as I do this.After getting the money the sollicitor now says that we can only get the keys after two days as the seller cannot move out before.He suggested I put the deposit on hold for 3 days which is costing me £50. I agreed to this, for the sake of humanity. However my solicitor called back again informing me that the transfers will take 2-3 weeks because the sellers at the top of the chain cannot move out before that. Our seller cannot move out, so we cannot move in.We were never told that the house was not available before May and we were always led to believe that we can move in as soon as we make the payments.I have been flexible when they asked for two days delay even though i was incurring the cost but now I feel that I am being duped and my sollicitor is not working in my best interest.Please Help |

So you have exchanged contracts but not completed. If your solicitor told you you would e completing on a particular day then you should have been able to move in on that day. If the person at the top of the chain has no-where to go this isnt your problem. hey will have to move into rented or hotel! |

You need to check with your solicitor as to whether completion has actually taken place. if completion has taken place, you are the legal owner of the property and you have every right to be in occupation of the property or at least be in receipt of rent from who ever is in current occupaion.
the procedure usually is that on exchange of contract, a completion date will be agreed between the parties to the contract and such date is usually fixed. your solicitor would have received an undertaking from your seller's solicitor that vacant possession would be given on completion. However, if for any reason completion cannot take place on the ageed date, your contract would have stipulated some sort of compensation or readress in your favour.
i suggest you go back to your solicitor and demand full explanation of the whole situation. afterall, you are paying for the service.

That's the antiquated system of house buying in the UK for you! The whole set up needs revising, Solicitors work hand in glove with each other, so don't expect any help from them, if there is a chain, you'll have to wait I'm afraid! |

You should check with another solicitor, If your solicitor said you should have the keys within 2 days i would chase him/her. Do you have this in writing then you can claim from your solicitor for out of pocket expenses through no fault of your own.Press your solicitor as they work for you and obviously they are not working hard enough. As you are the one worrying over the weekend ,do you think your solicitor is? |

Normally, solicitors don't exchange contracts on a property unless a Legal Completion date (the day you get the keys) has been agreed. Sometimes you can exchange with a "deferred completion" (where the LC date will be sometime in the future).
You say you have signed your contract but you don't say whether contracts have been exchanged - the point where the move is legally binding - or whether you gave permission for your solicitor to exchange. If you have exchanged and the agreed LC date has passed, then I would be speaking to your solicitor about this and, if I got no joy I would be asking to speak to the senior partner in the practise.
However, if you only "signed in readiness" for an exchange, and paid your deposit as it was hoped you could exchange shortly, then there isn't much you can do. It just looks like your solicitor has jumped the gun in asking for your deposit so early, so the best I can advise is to ask for your deposit back, unless you have a confirmed LC date within the next week. However, make sure you pay the deposit immediately you have a definite date, as if you don't you'll be the cause of the next delay! |

you cannot move into a house until completion ; however, you should inform your solicitor that you ar not happy with the vendors changing the dates and expect him to ask for compensation. also, say that if you expect the vendors to make arrangement s to move out even if that means they will have to stay with relatives. they have the problem not you so should not make it your problem. |

Get another solicitor to check your contract normally once you sing the paper and agree the date to move that is set in cast and stone and any movement may lead to compensation as you probably are loosing money. Make sure that a new solicitor has checked everything because there may be some dodgy clauses |

if u have no completion date then it can take weeks but when contract have been signed it has to go through. if you stop it you lose your deposit. i had over a 2 week wait for my first house |

Hey guys. I have a question. My parents are buying a house, that they lived in for 3 years. Has rented. My mother loves the house so much that when the former owner has lost the house in for closure, she wanted it for her self. Now she has singed a contact for that house. The problem is the realator is telling her she can not move in untill 6 months.!! Why you may wonder he says that the bank owns the house... But the house has a new owner..
