There is a leak on the ceiling of my bathroom right above the bathtub. When the tenants upstairs run their water the ceiling bulges and drips. I called my landlord on Monday night when I heard it dripping and I waited up for the maintenance guy but he never showed. It is now Wednesday afternoon and nothing has been done about it. I have called to remind her a couple times and she says she'll have the maintenance guy fix it. I cannot take a shower or give my daughter a bath because I don't feel like having a ceiling fall on us... Is there a time-frame that they have to fix this? Do I have any rights? I cannot shower!! I took my last shower on Monday morning and I am guessing that it still won't be fixed tonight or by morning. And whenever he does decide to work on it, I am guessing it's not gonna be a few hour project... What can I do? |

I had a similar problem and I witheld my rent until it was fixed. I dont thing I was allowed to do this but I told her that as I wasnt getting full use of my home then she wasnt getting full rent. It worked and the workmen came round that night. |

if i was yourself i would withhold rent ,until sorted out ,you may feel a bit awkward saying this ,but you have to .
I am an electrician ,and i do plenty of work for these landlords ,majority just want the money !! not the hassle!!
im sure if you tell him the work will be done sharpish! if work is a big job ,get him to pay for other accomodation ,remember if you withold rent ,it takes a landlord 3 months to get an eviction order ,you hold the aces !! |

Please visit www.shelter.org if you are in the UK. They give fantastic advise on how to deal with landlords and repairs and even the given time frame required. You have to put your request in writing and give the landlord a set time frame. Have you spoken to the people above- they may not be aware they have a leak- your landlord is not at liberty to fix the problem unless she owns the property above! |

Call her up and tell her you can't shower and that if she does not have someone over to fix it today or tomorrow, you will report her to whoever you have to, to get something done! In the mean time find out who that is and report her if she doen't get it fixed! |

It depends on where you live. I have a flat in london and have reported repair and safety requirements to my landlord monthly, in writing, by recorded delivery mail and am still awaiting a response. These are not as urgent as your problem so I am just moving out at the end of my lease. However in your case, you need to take action now as clearly you and your child should not be placed at risk. Have you discussed the problem with the person upstairs. They may
be unaware of the problem and it sounds really as if the problem exists in their flat, not yours. They probably have some dodgy plumbing. If you were to approach them, as well as your landlady you might get a better result. If they own the place they will want to fix it ASAP as they are in danger of ending up in your bathroom if the floor comes through.

It completely depends upon the state in which you live. Each state has its own Landlord/Tenant laws, and they vary widely from state to state. I have been an attorney (licensed in Tennessee) for about two and a half years, and while I do not specialize in L/T law, I am can tell you that the best thing you can do is to contact an attorney in your area who does. |

The timeframe is 30 days unless its an emergency.
It only takes a minute to stop a leak and, yes, only a few hours to replace a piece of drywall on a ceiling.
Make one more phone call. Inform this nice lady you will go to a hotel to shower, and include a copy of the bill with your next rent check with that amount deducted. |

Firstly, make the tenants upstairs aware that there is a problem with water coming in your bathroom every time they use the water. They may not be aware of any problem, but if you point it out , it may be that they are responsible for fixing the leak not your landlord. Having said that read carefully through your lease, to see your landlords responsibilities. |

By the wording of your question, I am thinking you are in the USA? If so, I'm UK so things would be different here. However, as a landlord I would be onto it straight away. I would speak with the people above, and then contact the Maintenance Company for the apt. block who should be onto the insurance company. The leak is the responsibility of the people upstairs, but their insurance claim should include making right whatever damage is done in your apt. Other than that, I cannot advise further. |
