What are the legal consequences of eviction if there is no monies owed to landlord?
I believe my property manager is trying to evict me & my fiancee because she has a personal problem with me. they gave us 2 prior notices about "junk" on the balcony (2 bikes 1st time, 2nd time not sure) then just served us a 3rd "eviction pre-warning" notice (stating there is still junk on our balcony - my dogs or a swiffer is all i can think of) saying we have one more screw up and we are out. They still havent fixed our broken bedroom window or the leak under our sink. And now for some reason, they didn't accept one half of both of ours rent (although funds were available) checks which I believe will make us violate our lease. If they do evict us but we are all paid up with rent etc, what are the negative effects that will fall upon me and my fiancee?

I live in Fort Lauderdale Florida. The weird thing is our lease is up April 15th but back in January they made us renew the lease even though our year wasn't up yet.

First off, this is just a scare tactic. Property managers who will evict you over these things are few and far between, sometime to far between even if the residents are disturbing other residents, its much more important to keep the occupancy percentage up. Additionally it is hard for a management company to get evictions for things other than non payment as they are much harder to prove in court, our attorneys know this and won't file unless there is a good case.

If this is a big problem and you really think you are being evicted and do not really want to live under this scrutiny, ask the office if they are terminating your lease for eviction, if so ask them to write you a notice that they want the lease terminated and you can then move out with no penalties and no eviction. If they ever try to sue you have your letter saying that they terminated the lease early, not you.

If they really do file eviction and it goes to court, depending on the jurisdiction you may be blamed as the cause of the lease default and there for owe a termination fee for terminating the lease early by your actions, but many times courts will not find in favor of this charge as they recognize it is the landlord who has decided to term the lease.

Either way if it goes to court and a writ for eviction is issued, this will appear on your credit report and make it very difficult to find other housing unless you go through private landlords and pay a high deposit. Many professional management companies will not consider an applicant with an eviction.

If it is extremely important to not just get out, but also keep the eviction off your record, I recommend talking to an attorney. Be careful however not to initial tell or threaten the property manager of this. They are not responsible for the end result of the lawsuit and often will peruse meaningless cases out of principle because it is not their money they are using to do it.

In addition, renewal leases are not binding till thier start date. If your new lease does not start till april 15th then you should give your notice to vacate and move out. Ensure you notice is in writting prefferably by means of certified mail, very cheap and well worth the expense.

I would complain to anyone who's above your property manager. Inform that person that the property manager has started a vendetta and is harrassing you over trivial matters. Have evidence to prove your case and let them deal with the property manager regarding the harrassing conduct. As for the selective payment of rent, you may want to accuse the property manager of skimming the rent check since she counts only your fiancees portion and not your portion. Be polite and rational and you'll be surprised.

Your property manager has to show cause to evict you. Not paying the rent is one cause but there have to be other causes established in your lease and according to FL renter law.

Finally, start looking for another place with more reasonable personnel.

Depending on how they file the eviction in court, it can show up as a civil judgement on your credit, or even "just" as a "court action" when someone would do a background check on you for jobs and stuff.
Most importantly....an eviction will cause you trouble each and every time you go to rent an apartment or a house.

Try to work it out with the skanky witch---Sit down and say "if you want us out, let me know right now, we can work something out"....sometimes you just cannot get a break with some people....and then look for another place to live.

You'd have a negative report on your record, but no actual legal consequences.
I don't know what recourse you have in your area. Most countries have mechanisms whereby you can challenge an eviction notice and also to be in dispute over the lack of maintenance. Take pictures of your balcony to be able to back up your assertions, as well as pictures of the broken window and the water under the leaking sink. Contact the rental disputes authority and find out how to challenge their assertions as well as put in your own.
It may be they are trying to evict you for other reasons apart from your 'messy' balcony. This may be for redevelopment or because some friend wants your apartment.

Nothing should be able to go against you. You need to read through the contract you signed when you first got the apartment. If they're supposed to fix it, then they have to do it. It sounds like they aren't holding up their end of the contract, though.

If you think there is a problem and they're later demanding money from you, take them to court (and I think you should leave the place regardless with such a landlady).

If you are in breach of the lease (I'm not judging whether or not storing "junk" on the balcony is a breach of your lease or not), even if it's not over a matter of money you can be evicted. In that case, if they succeed, they would get a judgment for court costs, which if recorded would become a public record and show up on your credit history.

Your landlord can not evict you without reason. As a tenant you have rights too, but those vary by state. It seems in your case leaving would be the best scenario for both you and your landlord. I would recommend to try and work out an end of lease agreement.

they have to have a reason, and since your balcony is the problem they have the right. if you have cleaned up the problem and they are still giving you a hard time, document all conversations between the property manager and yourself. keep all copies of cancelled checks and repair orders. take pictures of the problems reported and make another report. If they have not fixed the problem,and are still threating with eviction, do not pay any more and wait until court. make sure that you have all documentation of conversations so that you don't like an dummy in court.
