you have to move.
if you tried to go to court w/this, the judge will side with the landlord, on terms you had time to prepare for the sad event they passed (basicaly you knew it was coming) and you could've been out in a timely manner. (unless it was a spouse, then you could be granted 30-90 days)

Even if you are not on the lease, if you have established residency in the unit by living in the place for awhile, collecting mail the landlord can not just evict in three days,
It would also help if the landlord knew you where living in the unit for a period of time before this, if so he would be prohibited from claiming you where not a tenant because he had past knowledge and did nothing to cure the issue
that said most likely you are on a month to month rental and probably have a month to find a new place or so, but not three days in general |

None. It would be deemed as sub-letting if your name was not on the lease, and that would not be allowed. |

You have no rights. You could ask the landlord if you can lease the place, but he'll do the same background and income checks. Otherwise you need to move ASAP or risk him getting rid of your stuff himself with a dump truck. |

I'm very sorry to hear the passing of your roommate. The landlord has a right to ask you to leave, but also has to be reasonable in giving time to remove all of your belongings. The landlord can,t put you out that fast, he may tell you that you have 3 days, but you can that as long as you have to because you can't be forced out by him nor the Police. That matter has to be taken to court whereby the landlord has to get an eviction notice served. |

Wow! So many wrong answers and so much bad advice in such a small amount of space.
You were a subtenant of the original tenant, even though his lease may have forbidden that(let the LL evict him for breaking the lease). Now, since you have possession, and no lease, you are a month to month tenant. The landlord has every right to expect you to pay the full rate of the rental. Also, to get you out, he has to give you a 30 day notice(unless you don't pay, then he can give you a 3 day notice).
These are general laws, so you'll need to consult with an attorney in case your state/area has different laws. |
