What are the rules the landlord to be able to come to the house?
My girlfriend is renting a room less than a mile away from me we both live in Mountain House CA (95391) and the house in which she is renting has all the rooms rented out including the studio in the front of the house, except for her master bedroom. All the people living in the house get along really good with each other and everything is ok between them, the only issue is the owner of the house, she keeps coming back to the house every week just to get a couple of things and she hasn't moved all her things out. everybody who lives at the house has a lease and a contract, and just this morning everybody found out that the owner of the house is going to be bringing all her family and relatives (30+ people) to the house for thanksgiving and everybody who is renting is furious and she said she can do what ever she wants that it is still her house.

Are there rules against this and against her showing up every week for no reason and with out letting anyone know she is coming?

FYI: she doesnt live at the house anymore, she moved out and lives in san jose but she still comes often to get one or 2 things, she officially doesnt live thier

She must give all of you 24 hrs notice before entering. There is a gray area if she is keeping a space for her own use, but that does not sound like it is the case. She should have had all her stuff out before anyone moved in. You all should get together and see a lawyer.

She CANNOT have her family there. She still owns the house but it is illegal for her to do what ever she wants with it when she has tenants. She cannot have free rain of the house. It is illegal for her to use it like that when it is rented out!

She needs to learn the landlord/tenant laws before she gets sued.

EDIT: I think you can find it by searching for " landlord tenant law California" Oregon has a web site for all that stuff, so I assume CA would too.

So LL does not live there and rent out rooms in her house, she moved out and rented out rooms.
YES there are rules against this. READ the leases, and get everyone together and stand up to LL. She is out of line. May be wise to get an attorney consultation, have a letter prepared to LL, should be cheap. Initial consultation cheap or free.

If they - as a group - are renting the whole house and splitting expenses they have the right to ask to landlord for proper notice.

But if they are renting individually, room by room, then the landlord has obviously retained a storage area and can have free access.

As far as Thanksgiving I would say that goes over the line. If your girlfriend wants to protest this I say all the tenants merely announce now that it is unacceptable to use their home as a banquet hall and they and their friends will be lounging around all corners of the house (except the master bedroom) all day either naked or in their underwear.

They might further threaten to turn her in to the county for running a hotel/boarding house, which requires a special license in many places.

She rented out bedrooms, not the house.

The landlord is free to come and go and to use her house as she sees fit, with the exception of the rented bedrooms.

Since she is still residing at the house she does not need to tell anyone when she will come and go, no more then your girlfriend needs to inform others of her comings and goings.

It depends. If they are only renting the rooms but NOT the common areas, the landlord is in the right. They should read their leases carefully to see if the landlord is violating their rights.

Under no circumstance's can the landlord enter the rental property unless they give you 24 hours notice. If the landlord is trying to sell the house they still have to give you 24 hours. If your landlord keeps showing up at the house, I would start writing down into a log book every time they come over unannounced and then take them to court. I have heard of this before and the tenants won. There rent got freezes until the day they moved out. So they can never up the rent at all until you move out. The landlord had to give them 48 hours instead of 24. It may seem pretty small but when you are tired of your landlord coming and going when they want then this will put a stop to the problems.But just so you know a landlord can kick people out with regular notice so family can move in. I don't think its right but family comes first. I only know this because my brother is a landlord.

it sounds very unfair whatever she is doing, i would think there is a clause in the lease which states she must give notice before entering (especially if she aint living there anymore)

If unsure check with the firm who created the lease. I work in a estate agency / lawyers and constantly get questions from tennants who need advice. check with them and they know by law what the lease entails. they wont mind answering questions either, and if they are anything like our firm they will be happy to help ;D

If she only technically rented them room and not the common areas then yes. It all depends on how the contract reads. Most likely she cannot come over though.

It is common for a landlord to live in one bedroom of a house and rent out the spare bedrooms. In this situation all areas other then the bedrooms are considered common areas (or shared areas). Anyone living in the house is free to enter the shared areas and bring guest into the shared areas unless the lease gives specific restrictions on guests. This appears to be the case here. The fact that the landlord doesn't actually live in the master bedroom is irrelevant. The bottom line is that your girlfriend is renting a bedroom, not an entire house, and therefore she isn't guaranteed any privacy in the shared areas, only within her private bedroom. There's nothing illegal about the landlord having 30 guests for thanksgiving as long as they stay out of the privately rented bedrooms.
