What can I do if my landlord sells the house that I live in, I have 10 months left on a 1 year lease?

In general the new owners must honor the lease terms, the lease flows with the property

Real Estate Guy
Usually leases run with the property, not the owner. The new owner has to honor the lease until it expires.

Unless it's written otherwise in the lease (read it), you will not have to move until the lease expires.

scott d
read your lease carefully to see if there is a sell clause. If not the new owner will have to abide by the lease or file for eviction , which they will probably lose unless it's provided for in the original lease...

Hang tight. The new owner may let you stay or pay you to leave.

AllCourt
Some good answers already. Usually the new owner has to honor the existing lease (unless, in some states, the new owner is as a result of a foreclosure). You can possibly record the lease, or ask that it be included with the property listing. Chances are, the buyers will know in advance that it is rented and have seen the lease.

You want to be sure that your security deposit(s) are properly handled as well. They should be transferred to the new owner who has to do a final walkout when you leave (which you should be able to attend) and return any unused deposit (with interest in some states) to you.

Check your local landlord/tenant law - there's probably a website or something in your area that addresses this exact scenario...

File your lease at the recorder's office if that is permitted without being notarized. If you can't do that, give a copy of it to whomever is closing the sale. This will put the buyer on notice so they will have to honor your lease.

If the property is listed with a real estate firm, give the agent and broker a copy of your lease and make sure they include that in the listing.

If the seller wants out, have them grace your palm with silver to buy out your rights.

wondering the same

He needs to give you 60 day written notice with reason and of course the reason is he is selling the house.

jen415
Pretty much nothing. That is the one reason a landlord can kick someone out without any problems

you can get him to apy your move out expenses though

But EVERY tenant law changes depending on city and state. SO you should call your city's renter's rights department
