Depends on where you live. Local laws govern tenant / landlord rights. I owned a place that I was subletting in NYC and I can say that NYC is not landlord friendly. It took me 1 year to evict a non paying tenant. In NJ it is somewhat easier.
I can only recommend that you start your case NOW with well documented letters and warnings. |

Give them a written notice, stating that they were not to change locks, without giving YOU a copy of the key. Write that they have not paid their due rent, and that they have 30 days to leave the address. Plant that letter on their front door, and take a pix of that, for use in Court, if you should need it. |

They have to pay rent per the lease, and they legally cannot change the lock on your residence. Call a locksmith, get it changed, and keep the security deposit. You can also take them to small claims court to get the rent, and reimburse you for the cost of getting your locks changed again.
I'd try to call them before anything else though, and log exactly what is said during the conversation. |

Yes you can but you will need legal assistance. Personally I would contact your local CAB Office and speak to one of the legal advisors there. If you do not have time to go there when they are open you can always call them, again find the number online.

You can send them (certified mail) a Notice to Pay or Quit and a notice that they are required to supply you with a key. (This should be in your original agreement).
If they do not do BOTH-you can file paperwork to evict them. Make sure you follow the laws in your state |

I`m a bit confused here in your question. You state that the tenants have not paid last rent? What do you mean exactly?
Well if they have not paid there rent you first must give them a 3 day notice to pay rent or quit.
This must be done before you can start eviction.
Also give them a 3 day to perform notice about the locks being changed. But get the rent part out of the way first.
It is your right to have the key to you own place in case of an emergency. If they do not produce that key any damages to your home to get in durning an emergency would come out of there security deposit.
Evicting your tenant for changing the locks is a bit over doing it. If you are not careful they could sue you. |

laws vary from state to state, but hopefully you got them to sign some kind of contract. if you want to wait a little longer and tell them to pay 2 months rent this time then do that ..but if they don't then you will be out 2 months rent and most likely you still have to give them 30 days to move out. otherwise just give them an eviction notice and make sure you document it for court that you gave it to them (take a pic or something) and tell them to get out. |

Well for one thing since you own the property I am fairly certain that they don't have the right to change the lock, so you could probably sue them for destruction of private property. As far as evicting them I think you have every right if they are not paying rent. I would contact a lawyer who specializes in property law to be sure what your rights are. In the future I would suggest writing something like that into the contract before renting to anyone. List out what they can and cannot do to the property, and what the consequences are if they do, or if they do not pay rent on time- then you should be covered. In this case if you did not lay it all out in the contract I would definitely contact a lawyer so that you do not get hit with a countersuit. good luck! |
