I am waiting to move into a house that I plan to rent. However the tenants were suppose to be out by yesterday 8/21. When I arrived with the landlord if looked like that haven't even started moving. So what can the Landlord do legally to get them out of the house? The damage deposit is not an option because the garage door is broken so the teanats are not getting that back anyway. |

Basically, they get the police involved to physically move them. They shove their stuff out onto the street, remove the tenants and change the locks. |

If he served them an eviction notice or they put in to move, then he can have them removed from the premises. |

He can call the police and they will go there to evict them, I've seen that done before. The police will stay there until all of their things are out of the building. |

If they are there past the agreed upon move out date, he can file a complaint to evict them. They will be considered holdover tenants, and depending where you live it could take days to months to evict them.
What does their deposit have to do with anything? |

It all kinda depends on the verbiage of the lease agreement those tenants have signed and also the regulations of the state the property is in. |

Depends on which state you live. Most places, the landlord needs to give 30 days written notice, then another notice, then pay the sheriff's office to send a deputy to serve an eviction notice.
It is easier for the landlord to demand payment for the damaged garage door. He does not have to take it out of the deposit. When the tenants do not pay for the damage, especially if he has already given them 30 days notice, he can change the locks on the house. He will then have to be around to let the tenants in and out; but he can hold an item that is not a necessity, as collateral until he gets paid.
It does depend on which country, state, and city you are located.
Some places the locks can be changed immediately and some places a written notice and application to evict is needed first.
In you situation I would make sure the landlord returned you deposit and rent until he actually has cleared out his last tenants.
Most renters will get in a huff and move out rather quickly when asked to pay for damage.
If the tenants have financial/sickness int the family they can sometimes be very hard to move out. Most states protect hardship cases, which makes it difficult to get them to move out. |
