What can an apartment landlord discriminate against when choosing tenants?
I own a small house with a couple of apartments in it. The lower apartment is vacant again-- It's only a tiny two-bedroom apartment and I've recently begun to advertise and seek out renters.

It seems everyone who has come to see it has had 2 adults and 2 or 3 kids. Most of them have babies.

I don't mind kids or babies or dogs or cats... but the apartment is simply TOO SMALL for that many people. And, furthermore, the other tenant in the house (who is an excellent tenant) has made it clear to me that he would prefer I get someone without kids.

I obviouslly KNOW I can't discriminate by race, religion, color, family status, etc, etc, etc. But what CAN I descriminate against? Can I state that I want 2 or fewer people living there?

simply you don't want to loose your good tenant, you may scrutinize, but not discriminate.
You may; consider the amt of automobiles they have vs the amt of spaces you provide off street.
...you may consider the applicants family amt vs bedrooms to tenants, sons, daughters & adults. i.e girl 1 bdrm, son, 1 bdrm & adults 1 bdrm...
...pets, thats your call if you want them and you do not have to rent to pets, they don't pay rent and you rent to people...
...is the applicant financially capable to pay all the rents and deposits up front and the rent with ease...
...are they the sort of tenant you wish to rent to...
...You needn't rent to anyone that comes off the street, you take their applications for review and scrutinize from there...if not acceptable to your criteria, just simply tell them your refusal is conceptual. there needn't be an answer to the question, therefore you offer no recourse to the applicant for debate in a legal situation and this can all be done with a call-back to the applicant....basically, its not up for discussion.

you're the boss of your home, not the tenant without scrutiany.

No, this would not be legal! A two bedroom is legal for a family of 4. Two parents, 2 kids.

A two-bedroom apartment is big enough for an adult couple and one or two YOUNG kids. When you advertise, just say "ideal for family with a young child. Please call for more information". When the prospective tenants call for more information, tell them straight out that the place is VERY small and not suitable for more than a couple and one child. You shouldn't really bring the current tenant's preferences into account when it comes to who to rent to.

I had the exact same dilemma when I owned a up-down duplex--only my small apartment was the upper one.

Advertise the apartment as "cute and cozy--perfect for a couple or 2 roommates." When they call, reiterate just that.

Also enlist the help of your current tenant. He/she may know of a friend or co-wroker that is looking for a place to rent. I had good luck with that tactic too.

You can limit the number of people for the apartment size. I was rejected from renting a one bedroom when married because the parking was 1 space per bedroom and even when we didn't have two cars they thought we might buy a second car.
Since your's is a two bedroom it really isn't too small for more than one person. If you allow two people you can't discriminate against children.
What you can do is have an application, show the apartment to several renters then pick on based on the best overall on things like credit and income. Tell each person when you will decide then those that weren't selected just need told you selected someone else without giving them a reason.

I would say to limit it to 2 adults and one kid or two kids of the same sex. Put that in the ad. Don't listen to your other tenant who doesn't want kids in the apartment. He is just saying that cause he wants peace and quiet, but you would be taking away the opportunity for a CHILD to have a roof over their head.

it sucks but your other renter shouldnt determine who you rent to as long as their credit is good and has the income to support it...technically its 2ppl to one room...so for a two bed you could have 4 ppl what happens if you get a single mom and her kid...thats only 2 ppl you really couldnt deny her an apt because she has a child.. i live in 2 bed small apt with 3 ppl. we do just fine...

you really can not discriminate on ANYTHING. However, you can be precise on how many people you have living there, and simply put in the Ad No Children.There is nothing wrong with that.

just because your "good" tenant wants no kids in the empty space doesnt mean you have to listen. its not his apartment. as far as discrimination...it makes you sound like an *** when you say you want to find something to discriminate against to keep people from moving in thats illegal. but what you can do is limit the amount of people to 2 per bedroom or 1 per 200sq. ft. or something like that. dont be a hater!
