I received a phone call tonight from my brother's landlord telling me to come get his belongs or he was going to put them outside. There was no court order, no hearing, no nothing. He went into the apartment, and packed up most of his belongings. I told him that what he was doing was illegal. He has already rented the apartment to new tenant. Of course I moved my brother's things out for fear that he would loose everything. But there is a lease stating that the apartment belongs to my brother until March 2008. Who should I report this to? What can be done about the landlord? |

First you should move all of his belongings to a storage facility. Then bring this matter to court and the landlord will most likly have to pay for the storage fee's and allow him to stay up until the lease is over. my family went through this once, except there was no lease and the landlord gave us three days to move out. we put everything in storage and the landlord had to pay for that and like double our security. |

If your area has a landlord tenant advisory board talk to them. If not generally your only recourse is small claims court. However, if your brother leaves based on a phone call it will be hard to prove that he was evicted. The landlord could claim he abandoned the apartment.
My advise - do not move out. Keep a copy of the lease with you at all times and call the police if the landlord tries to move anything out. If you are really concerned tell the landlord you will leave when you get a written eviction notice stating the date you have to be out and why. This way you have proof and can sue the pants off the scumbag landlord. |

Your brother ( or his legal rep) has to bring legal action in the local court. This should be done immediately (emergency orders are possible). This is one of those situations where possession is 9/10s of the law. If your brother's things are still in there, it is much easier. If the stuff is out and someone else is there, it is very hard.
In reality, when the landlord came you should have called the police for the landlord trespassing. If your brother has a valid lease the landlord has no right to enter the property or touch your brothers stuff without appropriate cause (emergrency flooding of the property or fire, or your brother using the house as a meth lab, etc) |

DId your brother pay the rent? Does he have any late rent? If he does then the landlord most likely reserves the right to evict him on a certian date. Read the lease over and see if there is anthing abotu eviction for late or no rent. If hes in the wrong I guess you could go to the police. But I mean if hes found in the wrong and he lets your brotehr return would you WANT him living there with an enemy? |

On the first day that payment is not made as agreed, the landord can put a notice of eviction on, this will typicly be 3 or 5 days, at the end of that, they are out. there is no hearing, no court order, its that simple, tell your brother to pay on time next time. |

we are sueing him for that and sexual harrassment.
chain locks had to be put on the doors because he would come and go as he pleased.
we contacted the sheriffs dept. who put us with the right people, along with a lawyer.
