What can do if your landlord hasn't given your security deposit back and its been 25 days?

If you left the place like a pig pen you should not get it back. If you left it as clean or cleaner with no damage he will give it back and the time depends on your lease agreement.

First, what time period does your state law prescribe? Some are 10 days; some are longer. You need to know if the time has passed.

When it has, write him a letter demanding it be returned immediately. Mail it Certified Mail, Return Receipt Requested. Mail a second signed copy First Class Mail and get a Certificate of Mailing. This may be over-reacting but it doesn't do any damage and won't cost more than a few dollars.

If he doesn't respond, you may have to go to Small Claims Court. There you should prevail easily.

Be sure you have a copy of the back side of a check you used to pay your rent. It should have his account number on it. If you get a judgment, you'll need that information to collect.

Depends on where you live. In some states, landlords have 45 days or more to return a security deposit. It helps to know in which state you are located.

Most rental tenancy acts stipulate a time frame. Where I live it is 15 days. Where I live if the balance of the deposit isn't returned within that time the landlord must pay double.

* check to see how many days your landlord has to return all or part of your deposit
* expect to get interest added on
* expect to have deductions taken off if cleaning is required. Carpets and drapes are generally billed and that amount is deducted
* be sure to get an invoice detailing what you are being charged for cleaning (if anything)

Start with your local housing authority. This is such a common thing for landlords to pull that many areas have passed laws on it. You might have to take him or her to small claims court.

Good luck.

Legally, your landlord has 30 days ~ Has he promised to return your deposit, or is there a problem with damages? I'd wait until the deadline and then go to small claims court ~

banderson
Your landlord has 30 days to return it unless he can prove that you didnt leave the home in the same condition - worse off than standard "wear and tear". Has has to also get to you, in writing, why he isnt returning it - but not until the 30 day mark.

call him about it nad let him know that you can take him to small claims providing that you left the apartment in great condition. I hope you took pictures of it before you left they are extremely helpful in court.

contact him and tell him he has 10 days to pay back or you'll take him to small claims court.
