Jane T | What can we do?!! Help!? |
My boyfriend and I found an apartment that we really liked and were planning on moving into in 4 days. When we viewed the apartment, there were certain features that we really liked and made the sale for us (painted brick fireplace, nice doors that open out to a patio, etc). We went to look in the windows this evening to get an idea about the size of it before the weekend. Well, we find out that most of the features we were counting on (and were shown in TWO models) are not in this model. We were also told by the leasing agent that every apartment would look the same as the two shown. She also wouldn't let us view the exact unit at the time that we put a hold on the unit, because there were tenants living in it at the time. We both feel completely mislead and don't know if there's really anything we can do about it, except ask for an explanation as to why it's different than we were told.
Any suggestions on what we can do?! We haven't signed the lease- just a holding agreement. Help! |

I would approach it with a 'good', 'nice' attitude at first. do not let her know how mad or upset you are. If you treat her nicely, I'm sure she will work with you. explain what you thought you'd be moving into. if she says 'sorry', nothing i can do since you already signed forms and gave her a check, then I'd cancel the check if you can asap. if she has cashed it, she could say sorry and not help you. signing the contract and paying for it means that you are bound by that contract. i'm sure you can work it out. good luck. |

and take the loss or find a new place... |

I wouldn't sign a lease unless they provide one in writing to all those items that convey with the leased apartment. Be leary of shady landlords - and look at other areas besdies the "nice/pretty things" - such as faucets, windows, plumbing, other appliances that convey, A/C and heat work properly, etc. Also make sure there is some kind of "release clause" if you are not happy with apartment or get re-located because of a job"- EVERYTHING IN WRITING is the key here. |

You're absolutely within your rights to find another place. If there was any deposit, you certainly are entitled to every penny of it back also. |

Complain to the company the sales agent works for. That is completing unacceptable to be mislead like that. They promised you one thing and almost gave you something different which isn't something you should pay your money for...especially without seeing the actual unit your purchasing. |
