We bought a house in September. The seller disclosed a mushroom farm nearby that causes a foul odor when they rotate their compost piles, but did not disclose that a military base nearby routinely fires mortar rounds which are very loud shake the house all night long.
Is there anything that we can do about this? Some kind of recourse or something? Additional Details This is in Washington, I had a real estate agent, and i did not know that it was near a military base. (I knew there was one in Olympia but I didn't know it was only about 2-4 miles away) |

Something like this does not need to be disclosed. It is public and obvious. It would like having to disclose the house is next to an airport, it is an obvious fact.
I doubt even the farm was a legal disclosure, it was polite to disclose it, but not required. |

they aren't required to disclose that kind of stuff. only stuff about the physical dwelling that you are purchasing. they aren't selling you atmosphere, they are selling you a building with property. |

You know, when you live with somethiing everyday, you tend to shut it out and don't even think about it.
It may be an honest mistake, but the onus is realy on the buyer to checkout the locality for stuff like this. Military bases are shown on maps.
It is always a good idea to ask potential neighbours about the area, what they like and dislike. This would give a lot more info. |

You really have no case here, against anyone involved. Frankly, the sellers did not have to disclose the existence of the mushroom farm either, but were gracious enough to do so, since a buyer may not have known about it. However, the existence of a military base is extremely public knowledge, and you should have made that consideration when you purchased.
Understand that seller disclosures only require information which affects the actual property OR a pending development which might affect the value of the property. There is no requirement to disclose already existing developments if they are not an actual part of the property involved. |

Consult with a good real estate lawyer. The lawyer should look over the seller's disclosure paperwork and be able to make a determination on whether you should persue a lawsuit or not. |

A lot depends on where you live...laws vary from state to state, even by county or city. Your best resources will be found locally. Lawyers, realtors, city council members would all be good starting points. Good luck! |

Did you use a real estate agent? It would really help to know what state you are in. You would get more help that way. If you are in CA and this happened then the agent and the seller are responsible if you can prove it is something that they had to have known about and did not disclose to you. Also as far as the mushroom farm is concerned, not only should that be causing a foul odor but since those are grown in cow manure from what I understand, they should have disclosed that that can cause methane gas build up which is harmful to your health. I am not 100% sure if that happens with mushroom farms but I know that any of the homes here in So Cal built anywhere near a dairy or on the soil of what use to be a dairy have to disclose that. Just thought I would throw that one in there for ya. Big thing is if you received a TDS (Transfer Disclosure Statement here in CA) and these things weren't stated on there but were something they surely had to have known about. Again this is different by state. Good luck. |

They are NOT required to disclose that.
The fact there is a military base nearby is PUBLIC information, and therefore, it was the responsibility of either YOU or your REALTOR to make that discovery.
Anything that has to deal with zoning is not required to be disclosed separately...and that is what both of those properties are.
They were not required to disclose the mushroom farm either b/c it wasn't on their property...and that is also, public information.
