peaches | What do i do about a landlord that goes in when i am not home? |
i live in pennsylvania. i rent an apartment. my landlord pays for the heat, water, sewage & garbage. i pay $430 a month for rent & i pay my own electric. my problem has two parts. i have a lease, in the lease it states that he pays for the above things. last night he comes to me & wants me & the tenent upstairs to pay half the gas bill in the winter. can he do that if i have a lease? also, when i am not home, he goes into my apartment without calling. right now he is there & says he is checking the hotwater tank. it is in the basement, not in my house. what can i do about this? he has walked in while i was laying on my couch once & quickly shut the door when he saw i was there. does he have the right to do this? he comes in almost everyday & checks on things when i am at work. |

he's not allowed to come in when you are not there - tell him he can't do that and if he wants to check something - you have to be there with him. and you are protected by the lease - he can't ask you to pay more for the gas heat - be careful though, when the 12 months is up - he could jack up the rent a lot and there is nothing you can do about it - although he should be required to give you as much notice about a rent increase as you are required to give notice you are leaving - not sure who you could call or talk to about keeping him from coming in short of changing your locks, which I'm sure he would (b) itch about.
also - put some huge mousetraps on the floor inside the doorthat he would set off if he came in - get like 15 of them. |

No he cannot do this until the lease is expired. Also he has to give you a 12 hour notice before entering the apartment unless it is an emergency. I would report him. He has no business checking on things unless it's legit and you call about a problem. |

The lease should also stipulate just exactly when he can come in and 'inspect' the premises. Obviously he should KNOCK first and should respect your privacy. I'd talk to an attorney then look for another place to live asap. |

If your lease states the Utilities are the responsibility of the landlord then that is the agreement. He cannot Change the Contract without your Consent. if you do not agree to pay the Utilities then he cannot collect then under the provisions of the current lease.
As for the entering the property... Is there a paragraph that allows the landlord to enter the premises? Usually there is a "reasonable Notice" written ot implied. If the Utilities are located in your unit this may be a little more difficult to enforce because a typical leace also gives the landlord the right to enter to maintain and make repairs... Check your lease. If your landlord is reasonable then you should be able to talk to them and create a schedule for entering the home.
I would get a cheap wireless Camera... if you can connect it to the Wireless router you can monitor it from out side the home. If not then set it up with a motion sensor and a VCR.. If you are in the house then it is easy enough to keep them out. Get one of those security bars to prop under the door knob. Or a door Stopper a Chain on the door does not violate the (do not change the locks) provisions of the lease...
One other thing that is written or impled in all leases is that you as the tenant will have the right to QUIET ENJOYMENT of the home. |

If you have a lease then he can not change the terms without you agreeing , I would move if I were you this person sounds like a whack job. You have a right to privacy and I know at least in New York they are only allowed in while you are present , with an appointment or in an emergency... |

he absolutely cannot do this!! i had this same problem with my landlord. first thing you do is change your locks. even though he owns the place he has no legal right to a set of keys to your door nor a legal right to be in your home without your permission. you don't have to let him in even when you are there. the police department will have a list of renters rights. get a copy and show your landlord if he needs proof. my landlord got mad but he got over it. they know better than to break the law when it concerns rental property. he could loose his rental license for breaking the law and ethical codes. also, if it is under contract then he has no way of forcing you to pay the gas bill unless he writes a new contract and you agree to it and sign it. there is no telling what he is actually doing in your apartment while you are not there. don't ever take chances. change the locks today!! |

First, you have a binding contract which does not include any provision for you're paying for heat? Not to worry! Then, as far as the other issue, the landlord is not to enter your rental space, unless with your approval or in the case of a real emergency situation, which this is not! He has now breeched the contract, and you have the upper hand in all matters. Put him on notice...not to enter your apartment without you present! |

He can not change the terms of the lease. Don't agree to pay for the gas.
I would call the police and explain the entering situation to them. Most states require 24 hour notice, unless there is an emergency. Otherwise he is illegally entering your home. |

read your lease carefully-- if he is violating ANYTHING (including charging you more, intruding into your home, etc) you can contact your local law enforcement agency.
he doesn't have the right to come in and check on things unless it says that he can come in, unannounced, on the lease.

Only in case of an emergency can a landlord enter without your permission.I would contact the police in reguard to unlawfull entry...contact the city for which angeny that regulates this matter too. No he can not change the lease once both parties sign it. If you have a lawyer , ck with them on this. Don't worry....he can't make you pay any more or kick you out untill the lease is broken by either party. I hope this helps and have a good day. |

He can only go into your apartment without advance notice in an emergency. Put a chain lock on your door so you can lock it when you're at home.
You have a lease - you and he must comply with it.
In the meantime - I would look for another place to live. |

I live in PA, and your landlord sounds like my old landlord. A perverted scumbag peice of S&#^%. He would come in all the time when I was gone. The maintenance men would stare and whistle at me, and when I would get home, my dirty clothes hamper would be rearraged! I called legal Aide, and thats when they instructed me the PA has no real "privacy" law for the tenants. I moved as soon as my lease was up. So to combat that, you revert to your lease. If your lease states that your landlord is to notify you first-then he is and he has to abide by that or he is breaking HIS lease!
He is only to come unannounced if there is an emergency such as fire, gas/water leak ect. Depending on the circumstances, he should never let himself in without knocking first.
Yes, install a camera to catch his prying orse in the act. Then start looking for a new place ASAP. As soon as your lease is up move out. No he cannot make changes to how much you pay for gas if you signed to a certain amount a lease. If so, he would be breaking his own lease again. Grounds for you to move out. Call legal aide. The number is in the phone book under the blue pages.

A landlord can only enter your home w/o your knowledge in the event of emergency. Otherwise, they have to give at least a 24hr hour notice that they'll need to come in and why.
Sounds like your landlord violated the lease. |
