What do we lose if we decide not to buy a house after signing the contract and paying the earnest money? ?
The builder's sales representative is just playing with us and we are tired of that. We paid the earnest money and some deposit for upgrades. Do we lose everything? Does our credit will be affected?

Read your contract with your escrow company. In MOST instances, however, if you put up "earnest" money and rescind the deal, you WILL loose your deposit. As far as this affecting your credit, you will, unfortunately, have to READ YOUR CONTRACT to know for SURE !

You indicate a possible problem with the builder and yet your question merely says "we changed our mind." Which is it?

Consult an attorney with real estate experience, depending on who is in breach of what of your contract. Most of the time these things can be resolved with some blunt communication with the builder - believe me this is not the time for the builder to get a bad rep. Go over the sales rep's head for resolution if you need to.

well, i received this call from the district of columbia saying that my warrenty was going to be terminated, and now i dont have any money in my bank account. this might have been because my mom and grandma took all of the money out of it a few years earlier, but it seems like no coincedence. so if i were you, i would buy the house, plant some trees and then sell it.

If you walk away with no real reason then you lose all of your earnest money. There are some cases where earnest money can be refunded but only if the seller somehow did not uphold their end of the bargain i.e. something was promised to you in the contract that is not true/you didn't receive etc. Seller is taking too long is not a valid reason. Coldfeet is not a valid reason. Decided its too far from town etc. all not valid. The deposits for upgrades should be refundable since they are just that, deposits. Deposit implies refundablity, however, since every real estate deal is unique, you would have to find the exact area in your contract where it discusses the deposits. You may still lose them. Your credit should not be damaged per say but in future deals, sellers may be reluctant to do business if they somehow find out you backed out of a deal recently.

I don't think you should walk. If you don't like the representative, talk to a supervisor or lodge a complaint. Let them know that you are annoyed and thinking about walking away from the deal but be sure to tell them exactly why you are mad. Something like this happened to us last fall when we were trying to buy a foreclosed property. The seller had gotten a better offer after agreeing to sell to us. They stopped returning our calls and stuff, basically trying to annoy us into going away. We wouldn't so they eventually had to refund our earnest money.

(Later that deal fell through and we ended up getting the house anyway. Six months later, for $40,000 less.)

Anyway, the best thing to do would be to consult your agent with all of these issues. If you don't have an agent representing you, see if you can get one to come on now, or to consult, to act with your best interests (not the builder's) in mind. Calling a lawyer seems like good advice but would be so expensive and if you have no real reason for walking away, you are already going to be losing money.

I'm pretty sure the real estate agency gets to keep the money that's why you put the earnest money down in the first place. I don't think it affects your credit but your def not going to get that money back w/o a good fight.

If you signed a contract to buy a house that means you bought the house. But.........
They can't take the money you do not have. And..
There are consumer laws that allow you to change your mind about a contract if you act within the very short time allowed. This period of time varies with each state and locality.
