gafpromise, Is it really 30 days from the time they actually walk out the door, or 30 days from the time they said they were going to move? My situation is--my roommate decided to move and signed everything over to me, including the security deposit. She said she was leaving 12/31, but she left a couple of weeks early. She said she'd mail the keys, and when they didn't come right away I figured she was going to wait till the 31st. But it's been too long now and I think she's playing games with me.

I'd change the locks the day or day after they leave. Even if they turned in the keys you should change the locks because you don't know if they made extra copies.

Why are you waiting for anything? The tenant has the keys which means two things: 1st, it is a security issue, and 2nd, as long as the tenant has the keys they could legally be considered to still have possession and you could continue charging rent. Contact them any way you can - phone call and followup with a letter demanding return of the keys or you will continue to charge pro-rated rent, or change the locks and charge it against the deposit if you'd rather do that. Most states give you only 30 days to make all your charges against the deposit so make sure you do it less than 30 days after they vacate.

I suppose you should use the forwarding address and send a certified letter to tell them to return the keys or they will loose the deposit. and try calling them. then i would wait about 2 weeks unless they moved out of state.

The locks should always be changed between tenants. You don't know if they made extras and you could be liable if they used those keys to break-in to the apartment when there are new residents.

Change the locks asap. I think most landlords look at there places right after someone moves out. The sooner the better.

In Texas it is a law that the landlord is required to re key all locks between all tenants. We are also required to return all deposits within 30 days or give the tenant a written accounting within that time as to why they are not getting it all back.

Some of these laws may apply in your state also.
