the problem becomes, if the brother does not want to sell, you will have to go to court, which will cost some bucks to litigate out

so it may be finical wiser to try and bribe your brother into agreeing to the sell or try and sell your part to a relative willing to deal with your brother

Unfortunately, nothing.....unless you are willing to go see a lawyer and be prepared to haul your brother into court. My other question, can he afford to buy your half of the house? That may be another consideration. If he can't, that may mean you have to sell the house to a third party and divide the money from the sale between the two of you. I suggest you see a lawyer and find out what your options are.

You need to hire a lawyer and file what is called a "partition action".

It's not something you can do on your own.

Unfortunately, getting an attorney is your only legal option here. You will need a court order compelling the sale of the property in question and this would be extremely challenging to obtain without an attorney's assistance.

You could sell him your portion, have and sign a quit claim deed over to him. But make sure you take your name off the mortgage first. Even if you walk away with nothing, at least you will have pulled yourself out of a situation that could impact your credit.

Not a pretty place to be in, my condolences. One option may be to have a joint loan taken out for your share and then have you file a quit claim which means you'll not be responsible for anything that may occur. I'm assuming that you don't have much in the way of legal documentation as it is a family member. good luck with it, and good luck to your bro, it sounds like he needs it.

well either he buys you out or he has no choice but to sell. I assume this is through a divorce. Your lawyer can handle that for you but in the end, those are going to be his only two choices. Good luck

It sounds like a difficult thing.

Are you sure you want to sell at this point? House prices have dropped dearly! Unless you are from one of those places (like NYC) where prices did go up.

Anyway, if you think it makes business sense (that means profit) I would prepare a rigorous spreadsheet where I show him or her the profit he or she is loosing by not selling.

When people see NUMBERS they are more likely to take a decision. Go ahead, prepare the spreadsheet where you show:

* How much have you both paid (everything, including maintenance)
* How long has it taken you to pay that amount
* How much can you TRULY sell the house for
* Where could you put that money and what interest rate you would make (a trust fund, for instance)

With all this info, show how much money can be made, and then COMPARE to the alternative: not selling the house.

Chances are that if that person actually sees the opportunity cost of not selling (and your model makes business sense) then he or she will think it twice.

If he or she is emotionally attached to the house, I would probably try to sign another contract with him or her, in order to make an arrangement on the limit date to sell the house.

You have the right to sell it, he or she has the right to keep it---work it out!

You want to sell and he doesn't. Your desire doesn't outweigh his, regardless of what you think of him personally. Either you buy him out or he buys you out.
