What exactly can I do if someone discriminates against my section8 voucher?
Well I have been searching craigslist and a couple other places and many posting state "no programs". If I speak to the broker or landlord and I state that I have a section8 voucher they usually say sorry we don't accept any programs. Now I know that's discrimination but what I need to know is all the right steps to take in order not to be discriminated against due to my voucher? Please I am in serious need of help my time is running out. PLEASE HELP ALL OF US

Section 8 is voluntary everywhere except MA. No landlord is forced to participate.

You are not being discriminated against, as voucher holders are not a protected group in the fair housing laws.

Unless your state forces landlords to accept the vouchers (does not sound like it if they advertise they do not) you just need to plug along until you find one that does.

You might try looking on the other side of town, you may just be calling the wrong places.

The two main laws, from the HUD website, are:

Title VIII of the Civil Rights Act of 1968 (Fair Housing Act), as amended, prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status (including children under the age of 18 living with parents of legal custodians, pregnant women, and people securing custody of children under the age of 18), and handicap (disability). Title VI of the Civil Rights Act of 1964
Title VI prohibits discrimination on the basis of race, color, or national origin in programs and activities receiving federal financial
assistance.

There's nothing there about Section 8.

On top of that, a lot of landlords don't do Section 8 because there are a lot more regulations they have to comply with. It's a pain in the rear end, and a lot of them don't want the hassle.

So, no, it's not discrimination.

Talk to your case worker and get some guidance on where to find housing.

It's not discrimination, please stop trying to play the race card just because you get government handouts and it isn't all sunshine and unicorn farts.

It's an individual business, it's their choice and right to deny EVERYONE if they have vouchers. Now, if they deny you but allow someone else with vouchers, that's different.

If you really want that place, get a job that doesn't include any vouchers.

i dont know the answer your asking but thought id give my tid bit of info.

my sister owns homes and rents them out. in order for a home to be rented to section 8 and other programs, the home has to be inspected to meet certain codes and criteria. its a lengthy process and some ppl just opt not to have tenants with section 8, saving them the the protocol. i dont know so much if its discriminating in your case. First, id find out if they accept section 8 and then if they deny you personally, then thats worth filing a complaint.

the best way to find homes in your area that accept section 8 is to go to your county building and ask for their current listing of home owners that rent to section 8 program. its available information.

Each state is different look toward your attorney general web site, for in some states it would be illegal to refuse to accept sec 8 others its not, but irregardless of if they have to, the landlord can still require to past the same background check

That’s not discrimination. Fair housing laws do not require landlords accept housing assistance vouchers. That's the same as telling landlords they can't deny you because of your income so that they'd have to accept people who clearly can't afford the rent.

If they say “no programs” it’s legal, and a signal to you to look elsewhere. If it doesn't say "Section 8 accepted' or similar, don't bother with it.

Section 8 people usually tear up the properties they rent so landlords dont like them. Also if a land lord has so many properties, they can only rent like 25% of them to section 8 people (if i remember right) Also if landlords live within a certain distance of the property, they are legally able to discriminate based on almost anything. (basically they can say "I dont rent to women" and you cant do anything about it because they live so close to the property) i was shocked acutally when i found that out.

But sorry to say, you are basically in the same category as people with bad credit. You are forced to live in bad neighboorhoods because nobody in good areas will rent to you. Only advice we can give you is "keep on, keeping on" Sorry.

They have the right not to accept section 8 vouchers. It is actually not discrimination as those receiving assistance are not a protected class.

Stop looking on craigslist and start working with the people down at the housing authority to look for reasonable housing that is happy to accept your section 8 status.

You need to be searching for "income restricted" rentals. I'm sure there are plenty. Some people don't allow section 8, you can't just think that they are discriminating against you. That's a huge accusation, and it shouldn't be taken lightly.

What area are you looking in? Maybe I can help you find a place. I'm sure there's even a list of all the section 8 rentals in your area somewhere.

nothing, Not all places accept sec8 vouchers. it is a program that is run by the state and not all places are are enrolled in to it. It;s like taking a debit card. Not all places take them.

It's not discrimination. Most places have to be approved to receive Section 8 funding, they would know whether or not they are approved for it. They have be inspected and meet certain qualifications. The reason for that, is to prevent people from living in places that should be condemned. Landlords can refuse to rent to someone for a variety of reasons. People who have Section 8 funding tend to not be the type of people most landlords would want to rent to. You should contact the county office of economic assistance or the Office of Housing and Urban Development to find out who is approved. I would like to say that if you are unsatisfied with the places you are able to live in with Section 8 funding, then you need to work on bettering yourself so you can afford to live on your own independently, whether that means, getting a job, going to school, or whatever. I'm not going to be rude and judge you for it however, because I know that not everyone who lives in Section 8 housing is just someone who doesn't want to work. Sometimes it's people who need a place to live while they get back on their feet after various circumstances. Good luck.

Landlords get to make choices.

Participation in the section 8 program
involves a lot of restrictions on the landlord.

Something I never knew until I read the fine print on the federal anti-discrimination statutes is that properties under 11 units on which the landlord resides are TOTALLY EXEMPT !

. No, you can't punish a landlord for not accepting Sec. 8. The law was set up to avoid that.

You can call your section 8 program and tell them about the discrimination you are having. But I have found that if you meet with the landlord in person you have the opportunity to explain to him that he is guaranteed his rent each month with this program. You can have a letter of reference from your landlord stating your good history as a tenant. You have to talk talk talk.

Forget about Brokers they have their rules and will not bend. When you look at an apartment that is your opportunity to talk him into it.

I have in the past run into the same situation. One of the keys is to dress the best that you can. Dress as if you are going to work maybe a nice business dress or suit. It really makes a difference if they can see you at your best. The sloppier you look the worst your chances are. Unfortunately there is nothing legal that you can do that would help you get an apartment sooner. The best of luck to you!!! Dress up and speak properly.

The brokers office CAN NOT tell you that they will not accept the program voucher. Get documentation for this by asking them to sign off on that. They WONT - because they CANT. It is against the law and they know it - They wont put it in writing for that reason. Have you spoken with the social services department regarding your rights? They usually have a list available for you to review. The landlord can give you ANY OTHER REASON - Such as, No smoking - No pets - No good referrals, Etc... But they can not refuse rent to you because of hardship. If they tell you that make sure that you get that on audio tape... I have NEVER heard of being refused because of this reason...
