What happens if I break my apartment lease because I just bought a house? My lease is up Apr. 30th.?
We have had nothing but problems here, and they will not work with me, but we have put up with no heat and apartment flooding. They are saying it will go to court, do I have to show and will it go on my credit?

You are responsible in fulfilling your lease and if it is going to court (which it probably will) you had better show up. If not, you will DEFINITELY lose. The judge will give them a judgment against you for the entire lease value and any of their legal and attorney fees. If you don't pay, they can put a lien on your house and/or get your wages garnished, depending on your state. I recommend finding someone to sublet or try to "bargain" your way out of the lease by offering to pay for a couple of months and fees to advertise for other tenants. Sometimes that will work. Particularly if the landlord wants to get rid of you too.

timc_fla
They can take it to court.
But, it sounds unfavorable for them.
If it goes to court and you win make sure the judge instructs them that they submit a negative credit report.

Look at the lease for possible consequences.

If you don't show, they'll get a default judgment against you. You need to talk to a lawyer. The last thing you need with a new house is dinked up credit.

a contract is a contract..they can hold you to it....if there is no heat and flooding ..you may have an out that way... contact a laywer

If you gave a deposit you won't get it back. They will also probably have a penalty fee that you can just pay to keep a good credit and reference.

It would be in your best interest to show up for court, with evidence in hand on the living condition that you have had to put up with. What usually happens is you find someone to take over your lease, then they have the option of leasing on their own. But it sounds like this is a place that you would not recommend to anyone. Check with your local housing authority and ask what can you do legally to get out of the lease with out too much drama, if they don't know the answer they will direct you in the right place.

You have to pay the last few months until your lease expires, otherwise they can take you to court, and it will most likely show on your credit.

You will have to pay the remaining balance on the lease
until it expires. It will show up on your credit report.

First, if you break your lease, you will loose your security deposit.
Second, judging by all the hassles and the risk of going to court and having a black mark on your credit report, it may be more prudent to just pay off the remaining few months of your lease (even if you have to tighten your belt). Sometimes it better to spend more money in order to come out ahead in the long run. It stinks that you're stuck with such a lousy landlord. Good luck.

the only thing you would lose is your security deposit (if you have one) you would need to pay the landlord for whatever months the property is vacant until they find new tenants.a month would be long enough.

Go to court. It may go on your credit. I would check out a lawyer the one doing your houes closing will help you.

There should be a clause for buying a home. Read your lease.

Kelly H
well I would show up if I were you, just tell the judge about the poor living conditions, take pictures, or video. I dont think it will go on your credit, but I am not positive, It all depends on if yo are going through an agency or not I would say
