ikkles | What happens if I break my tenancy agreement? |
I'm 4 months into a 6 month tenancy agreement. And it's been hell. The people I share the house with are disgusting, they have people around all week, getting drunk, being ill, spilling drinks, making mess. They also let these people stay in the house whilst no one is here and I don't have a lock on my door where I keep things like my TV, laptop camera etc etc. Not only this but the house is always a mess, no matter what I do or say, even if I clean up, the next day its a state again. My housemates know I have to get up for work some mornings ay 530, and the latest I'll get up for work will be 7am if I'm lucky. I've politely asked them to be more considerate which hasn't worked so I made a complaint about 3 or 4 weeks ago to my landlords. They said they'd think about it (what is that supposed to mean???) but nothing has been done or been said to any one I live with. So at the end of the day I'm at the end of my tether and have found a cleaner quieter flat nearer to work. However, I've still got 2 1/2 months left on my tenancy but I'm going to just break my contract. The question is a) If its a joint contract for the house i.e. not per room, we all signed for the house am I breaking my contract and b) the landlords only have my mobile phone number and my housemates don't know I'm leaving so even if they can't contact me what is the worst case scenario that could happen??? Sorry about the long post. Additional Details I don't care about my deposit, it was only £100! |

I worked in a letting agents for quite a while about 18months ago and of course the contract will tell you in the small print what to expect, but if you signed as the main tenant, or a joint tenant you will be responsible for any damage caused to the property while your name is on it.
You need to put into writing and keep a copy a letter explaining what is happening and asking if your name can be removed from the tenancy as soon as possible giving the Landlord your forwarding address. You could even ask him to reply using your work address.
You should expect to lose any deposit as a sort of penance for leaving early, If you were to get any back think of it as a bonus. The other way is to ask the Landlord if you can find someone else to take over your part of the tenancy, this would cost as well but if you just leave and let them get on with it, you could be left being chased for thousands of pounds worth of damage money if they trash the house more once you have gone. Or unpaid bills at the end of the tenancy if they are in your name.
Its not a good situation to be in, but you can leave early by doing it the correct way and finding out what you need to know in advance. Go to the citizens advice with a copy of the tenancy agreement, and try to get things in writing rather than phone calls as it is much better for security and evidence if needed later.
Ask your work if you can have a little time off during the day to go to the citizens advice, they may have noticed you are having problems outside of work as lack of sleep can and does show on a person.

Presumably ALL of you signed the agreement? So long as they remain there, the landlord shouldn't do anything to you. And given their unreasonable behaviour, I can't say I blame you for going. Worst thing is that they could come after you fdor a few weeks rent- but they don't deserve it! |

I think you should just leave, if they only have your mobile number, all they can you is phone you and it is very simple to change the number.
But as one poster said, you have brought it to the attention of the landlord and he has done nothing, so I think you are quite within your rights.

my brother was in a similar situation. his landlord told him that he could go before the deadline but of the house was not in perfect condition he would lose his share of the bond unless he found someone to take his place and pay his part of the bond out.
it is in your favour that you contacted your landlord about the situation before you left. he has not upheld his side either by choosing not to look into your complaint.
worst case really is that you will lose money put down for the bond and that until the end of the contract you are still liable for any unpaid rent. |

Yes you would be breaking your tenancy, but if you leave, the remaining tenants will be liable for the rent, if you do not pay. The landlord does not seem bothered, as he is getting his rent, so you have brought it to his attention. He can use your deposit in what ever way he chooses, so could use it for your payment of the utility bill.
You do not seem to need a landlords reference to get this new flat, so go with it.
I suggest you move to the new flat, and when all your property is out of the room, sent the key back to the landlord, with a covering letter saying that despite your letter to them, nothing has been done about the other tenants, you feel you can no longer live in the property, as it was effecting your work.
You therefore return the key to the room, and please take this letter as my notice.
If the landlord has no forwarding address(pay the PO to divert your mail) then he can not find you, and you could leave without notice after 6 months, so he is loosing 6 weeks rent on one room, hardly worth the effort.
Just remember to divert your mail, otherwise the guys and landlord will not forward it on to you. |

If it's a joint tenacy then you would just be sticking your friends with the lease. The landlord can;t do anything about it nor would he care unless they didn't pay the rent. The onyl thing is your roomates can take you to civil court and recoup thier losses of your failure to live up to your contract you signed. I would say live up to your end of the agreement and be a man about it. I understand you're in a bad situation, but you should stick to your obligations. |
