I'm sorry for your loss. And it looks like your sister is trying to stake a claim to ownership by moving in. Luckily for you, possession is not 9/10ths of the law in this case.

You will have to take this to your state's probate court, and the court will decide how to resolve the debt and assets of your mother's estate. Of course, you need a lawyer to represent you. The whole deal will cost you maybe 10 grand or so. Shop around for a good lawyer. Do that right now!

The lien has to be either paid or removed, and you can expect more liens if your mother used Medicare services.

It sounds like your mother's financial affairs were not in order and on further investigation I bet you discover quite a few bills that remain unpaid and are due. You and your sister will have to deal with these things, and the sooner the better.

Usually the mortgage will say what will happen. Check the mortgage - ours includes people who will take over payment in the case that we die.

u can sell the house and start a new life but you don't have to unless u want to keep paying the bills.i really know cause my grandpa died and it was really sad but when he died he owned a house and my family didn't know what to do with it so these bills kept mailing in and my mom got so mad that she sold the house and now the bills are not mailing to the house anymore. but if u sell the house u have to set a fiance mortgage and u have to have an Allstate billing and u also have to have all of the bills to prove to the people who own the housing business

You'd need to talk to a lawyer in your state to find out what the specifics are regarding inheriting real estate. In some states, the house goes to the next of kin, be that a child or, if there are no children, a niece, nephew, cousin, etc. Of course, the person who inherited the property would probably be responsible for the balance of the mortgage and any tax liens on it. But again, the laws on this differ from state to state, so only a qualified lawyer could give you the proper advice.

You need to speak with a lawyer about getting the estate settled. This may mean selling the house to pay off the lien if there is no other money in the estate. Or you and your sister can pay it off, since it sounds like you two are the only heirs. One other thing to keep in mind. If you and your sister are joint owners of the property now, she just can't move in scott free. She should be paying you 1/2 of a reasonable rent for use of the house.

That would be a lien. Here, the Public Trustee takes over the disbursement of the estate.

You need to seek legal advice and then use your solicitor to get things moving.
