What happens if my rent was not paid and i had no lease can he pad lock my door without giving me 30 days?

The first 3 answers are simply wrong. For their sakes, I hope they're not landlords.

Lease or no lease, the landlord cannot lock you out even if the rent is unpaid. Only the courts can order an eviction. In many jurisdictions that can proceed fairly quickly but it still requires an order from a judge.

If a landlord locks you out without going through the legal eviction process he has committed a crime in most jurisdictions and can even be arrested! You can also sue him and recover substantial damages. You can also break in to the premises to retake possession without having to pay for the repairs.

I was a landlord for many years in the US and UK. The laws are quite strict on evictions. Lockouts without a court order are illegal in all 50 states and the UK as well. A landlord can be arrested for an illegal lockout in nearly every state and I had one arrested in Texas many years ago when I was a nearly penniless tenant myself.

This depends on your state. Although, I am quite sure in all 50 your landlord can not do this. He must first give you a certified letter "Pay or Quit" Notice usually giving you 5-10 days to pay before filing for an evicition at the court house.

call the police and see how quick he takes the padlock off, either that he gets arrested for trespasing, or remove yourself. Your side is a civil matter his is a criminal matter

Toni-- give the LL a 30 day notice and move out. Your making life to complicated. No place to put your stuff --rent a storage shed..

Technically, if you do not have a lease the LL can say that you are not a legal renter in that home.

If you have no lease he does not have to give you 30 days notice especially if you have not paid your rent. Even if you pay you rent he can lease the apartment without giving you any notice you have no written contract.

in most states if you are more than 30 days late they can lock your door with a padlock or change the locks if you dont have a lease.
